RESOLUTION 64-7 OVERRULING THE PL~/qNING <br />COMMISSION A/qD GRANTING A VARIA/qCE ON <br />APPLICATION NO. 1857 FILED BY RUBY MARIE <br />FRANTZ, SUBJECT TO CONDITIONS <br /> <br /> WHEREAS, after hearing on notice. ~he Planning Commission <br />DENIED a variance On Variance Application No. 1857, filed by RUBY <br />MARIE FRANTZ, and Appeal Application No. 115 was duly filed presenting <br />the matter to the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, <br />has determined that said Variance Application meets the requirements <br />of Section 9250.8 of the Santa Aha Municipal Code, that the decision <br />of the Planning Commission should be overruled and that said Variance <br />should be granted subject to certain conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Ana does hereby overrule the decision of the Planning <br />Commission and does hereby grant a variance on Variance Application <br />No. 1857 to permit the conversion of a portion of a single family <br />residence in an R-2 District at 1139 West McFadden Avenue, Santa Aha, <br />into a one operator beauty shop. Said Variance is granted subject <br />to the following conditions: <br /> <br />1. That the beauty shop be only for the applicant, non-transferable, <br /> and contain only one operator; <br /> <br />That the applicant provide off-street parking to City standard <br />at such time as parking restrictions are imposed on McFadden <br />Avenue; <br /> <br />That the following conditions be ccanplied with prior to the <br />issuance of a building permit: <br /> <br /> a. That an easement be provided for McFadden Avenue for a <br /> width of 42 feet, center line to property line, for <br /> street purposes and vehicular access rights. <br /> NOTE: Access can be determined and approved prior to <br /> dedication. <br /> b.
