R~SOLUTION 64-76 AUTHORIZING PETITION TO <br />THE BOARD OF SUPERVISORS OF ORANGE COUNTY <br />REQUESTING EXCLUSION OF PROPERTY WITHIN <br />THE CITY OF SANTA ANA, CALIFORNIA, FROM <br />THE LEVY OF ANY ORANGE COUNTY TAX TO <br />PROVIDE STRUCTURAL FIRE PROTECTION AND <br />MAKING FINDINGS OF FACT <br /> <br /> WHEREAS, the City of Santa Ana is a municipal corporation <br />nOw existing as such by virtue of a charter granted under the laws <br />of the State of California, and said City lies in the County of <br />Orange in the State of California; and <br /> <br /> WHEREAS, the California Government Code, Section 25643, <br />provides that the Board of Supervisors shall except from the levy <br />of any tax for structural fire protection all property within a <br />city petitioning therefor where the petition is supported by a <br />resolution adopted by the city council which makes certain findings. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Aha hereby finds and declares that Santa Aha is <br />an incorporated city which has an organized fire department in <br />operation and existence that at the time of adopting this Resolution <br />and for many decades next passed has been adequately staffed by <br />competent, well-trained personnel under outstanding leadership and <br />equipped with modern fire fighting equipment of all necessary kinds <br />and sufficiently supplied with fire fighting chemicals, which said <br />Department has access to the Santa Ana water system maintained at <br />high pressure; that the excellence and adequacy of said Fire <br />Department, its equipment, che~icals and personnel and the water <br />system of the City, including the reservoirs and mains and the <br />pressure of the water supply for fire fighting purposes, have been <br />determined by the National Board of Fire Underwriters, Conanittee <br />on Fire Prevention and Engineering Standards, to be among the best <br />in the State~of California and the best in Orange County, California, <br />so that Santa Aha now has the lowest fire insurance premium rate <br />existing anywhere in this area; that Santa Ana is now providing <br />adequate structural fire protection to all property within the <br />incorporated limits of the City and that no additional benefit in <br />fire protection is or would be received or required by such <br />property from structural fire protection given by the County of <br />Orange. <br /> <br /> BE IT FURTHER RESOLVED: That said City Council hereby <br />authorizes and directs that a petition be presented to the Honorable <br />Board of Supervisors of Orange County, California, attached to and <br />supported by a certified copy of this Resolution, petitioning said <br />Board to exclude and except from the levy of any tax imposed by <br />the County of Orange for structural fire protection all property <br />within the limits of Santa Ana, California, and Carl J. Thornton, <br />City Manager, is hereby authorized and directed to sign said <br />petition, a copy of which is attached to this Resolution, and to <br />present the original thereof, together with a certified copy of <br />this Resolution, to said Board of Supervisors before July 1, 1964. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its adjourned regular meeting held on the 21st day of May, <br />1964. <br /> <br />ATTEST: <br /> <br />ASSISTANT CLERK O~ THE COUNCIL <br /> <br /> <br />
