<br />Reference is made to that certain lease, ~ated July 1, 1941,

<br />were leased by the said lessor to said lessee, viz:

<br />dated ~y 5, 1891, ~d record~ in book V8, Page 97, Deeds,

<br />Parcel B - "That portion of LoSs 1~, Block A, Berry Tract,
<br />as shown on map recorde~ in Book 9, Page 6, said Miscellan-
<br />eous Records, ly~ southerly of t~Ae south line of t~t
<br />certain County Road, sixty-s~ (~ feet in width, knc~n
<br />es and called Xen~ Aven~e; said portions of Lots 8,9,11,
<br />12 az[~ i~, containi~ ~09.A~ acres of l~nd, more or less?

<br />Paragraph 13 of the a~ove referenced lease agreement provides

<br />This acknowledges receipt of your Lessee's "Election to ~xerclee

<br />0ptione, delivered to R. Carson Smith, aa ~ayor of the City of Santa

<br />Asa, on the 26tn day of June, 1947, together wits display of e c~eek
<br />
<br />drawn upon the Treasurer of the United States of i~erica for
<br />
<br />$~07,500.00 which cheek was retained by the War Assets Administration.

<br />lease above referred to, upon delivery to you, was aecompax~ied

<br />by Policy of Title Insurance issued by Security Title Insurance and
