RESOLUTION NO. 5628 <br /> <br />RESOL~TION CLARIFYING EFFECT OF ASSIGNMENT <br /> TO UNITED STATES GOVE~T OF RIGHT TO <br /> PURC~'A~%E HEAL PROPERTY <br /> <br /> W~.REAS, on the 15th day of December, 194~, at its <br />regular meeting, this council duly passed and adopted Resol- <br />ution No. 3623 and on said date, pursuant thereto, the Mayor <br />executed and the City Clerk attested an Assignment of Right <br />to Purchase Real Property to the United States Government <br />covering property leased by this City from M.H. Whittier <br />Company, Ltd. and in the pessession of the United States <br />Government, and, <br /> <br /> WHEREAS, the United States Government has requested <br /> <br />a clarification of the effect of such Assignment to it, <br /> <br /> N0~, THEREFORE, BE IT RESOLVED by the City Council <br /> <br />of the City of Santa aha that the acceptance by the United <br />States of America of the Assignment of Right to Purchase <br />Real Property from M.H. W~nittier Company, Ltd., as executed <br />December 15, 194V, by the Mayor and attested by the City Clerk <br />of this City., pursuant to Resolution No. 3623 of this council, <br />shall not be deemed to release or waive any rights, obligations <br />or liabilities concerning d-m~ges between the United 8rates of <br />America and the City of Santa Aha arising out of the fail,Are of <br />the City of Santa Aha to convey said property to the United States <br />Government purs,~nt to the terms of the lease between the City of <br />Santa Ana and the United States of America covering the property <br />therein described, should any court of competent Jurisdiction <br />determine by final Judgment that the option to purchase said <br />property from M.H.
