RESOLUTION 64-104 AUTHORIZING CONDEMNATION <br />OF REAL PROPERTY NECESSARY FOR THE LOCATION <br />OF A PUBLIC STREET NORTH OF SEVENTEENTH STREET, <br />EAST OF VALENCIA STREET <br /> <br /> WHEREAS, it has been determined that the present on-ramp <br />to the Santa Ana Freeway creates traffic backup and continuing <br />traffic hazard and that the same should be relocated to provide <br />connection with Poinsettia Street, and that the City must acquire <br />one triangular piece of property to provide for the realignment <br />of this on-ramp. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana hereby finds and determines that public <br />interest and necessity require that the Freeway on-ramp at <br />Seventeenth Street be realigned to connect with Poinsettia Street <br />and further require that said City do have and acquire for street <br />purposes, in fee simple, that certain land in the City of Santa <br />Ana, County of Orange, State of California, described as: <br /> <br />Beginning at a point in the Easterly line of Lot 28, <br />Block "G", resubdivision of the Nob Hill Tract, as per <br />map recorded in Book 6, page 3, Miscellaneous Maps in the <br />office of the County Recorder of Orange County, California, <br />distant Northerly thereon 11.01 feet from the Southeasterly <br />corner thereof; thence following that certain property line <br />described in a deed executed by the State of California and <br />recorded March 7, 1957 in Book 3830, pate 274, Official <br />Records of said Orange County, North 81v 22'03" West 4.45 <br />feet; thence North 42° 33' 00" West 136.93 feet to a point <br />of cusp with a curve that is concave Northeasterly, having <br />a radius of 178.00 feet, a radial to said curve at said <br />point bears North 47° 27' 00" East; thence departing from <br />said certain property line and running Southeasterly along <br />said curve through a central angle of 36° 21' 57", an arc <br />distance of 112.98 feet to a point in said Easterly line of <br />Lot 28; thence along said East line South 0° 06' 14" East, <br />47.24 feet to the point of beginning. <br /> <br />BE IT FURTHER RESOLVED: <br /> <br /> 1. That the City Attorney is hereby ordered to bring an <br />action in the name of the City to condemn said property necessary to <br />be taken and to do all things necessary to prosecute said action to <br />final determination; <br /> <br /> 2. That public interest, necessity and convenience require <br />and it is hereby ordered that said City take immediate possession <br />and use of the property herein ordered to be acquired upon compliance <br />with the requiraments of law applicable thereto as a right of way <br />for public use; <br /> <br /> 3. That said public improvement is planned and located in <br />a manner which will be most compatible with the greatest public good <br />and the least private injury; <br /> <br /> 4. That the City ~ Santa Ana, a municipal corporation, is <br />authorized and empowered to provide for the opening, extension, <br />widening, construction and maintenance of public streets and highways <br />within the City; <br /> <br /> 5. That said action in condemnation shall be taken in <br />accordance with the provisions of the Code of Civil Procedure and <br />the Constitution of the State of California relating to eminent <br />domain. <br /> <br /> <br />
