the said court, and which said action is now pending in said court wherein it is sought to be determined whether or not said lease be- tween the said ~.H. Whittier Company, Ltd. and the City of Santa Ana terminated as of the said 20th day of August, 1946, and Wt~REAS, in said litigation or action in the said District Court of the United States above referred to an order has been made authorizing and permitting the City of Santa Ana to pay into the registry of said court the amo~uat of moneys which would be due to said 1,{.H. %~hittier Company, Ltd. under the terms of said lease if said lease were not ter~minated as of August ~O, 1946, and V~IEREAS, the total amount of moneys which would have been so due to I~I.H. Whittier Company, Ltd. as rental and taxes and assessments under the terms of said lease for ~he two year period eonmuencing on August 21, 1946, and ending 2~n£~st 20, 1948, is the sum of ~19,897.21, N~% T~i~EFORE, BE IT RESOLVED by the City Council of the City of Santa Aha t~mt the ~,~yor and the City Clerk of the City of Santa Ana are hereby authorized and directed to draw a warrant against the Treasurer of the City of Santa Aha in the said amount of ~19,897.21 payable to the Clerk of the District Court of the Dhited States Southern District of California, Central Division, to be deposited into the registry thereof in action No. 8161-W Civil pending therein, to be held by said Clerk subject to orders and rules of the said District Court of the United States; and the Treast~rer of the City of Santa Aha is hereby authorized and directed to pay said warrant to said Clerk of said court upon presentation of the same by the said Clerk to the said City Treasurer.
