RESOLUTION 6k-123 OVERRULING THE DECISION OF <br />TEE pLANNInG CO~4ISSION AND GRANTING VARIANCE <br />ON APPLICATION NO, 197k, FILED BT BEAR STATE <br />BUILDERS, INC., SUBJECT TO APPLICABLE <br />CONDITIONS <br /> <br /> WnF~b~AS, after hearing om notice, the Pl,nui~g C~mmtssion DEN~ a <br />variance o~ Variance Applicatio~ No. 197k, filed by BEAR STATE B~ILDERS, INC.~ <br />and Appeal Applicatio~ No. 133 was duly fi~ed by the applicant presenting the <br />matter to the City Council; and <br /> <br /> ~L~HEAS~ the City Co~ucil, after public hea~ing on notice, has deter- <br />mined that said Variance Applicatio~ meets the requirements of Section 9250.8 <br />of the Santa Aua MA:uicipal Code, that the decision of the plan~ing C~mm~ssion <br />should he overruled and that said Variance should be granted subject to the <br />applicable conditions. <br /> <br /> NOW, T~EFORE, BE 1T RESOLVED: That the City Council of the City of <br />Santa &ua does hereby overrule the decision of the Planning C~tssiou and does <br />hereby grant a variance on Variance Application No. 197~ to construct a 10 unit <br />apartment that proposes parkfng and m~euvering in street side yard at 1136 West <br />Second Street, Santa Ana~ California. Said Variance is granted subject to the <br />following applicable conditions: <br /> <br />1. That the develo~ent be according to plot plaB except for minor <br />modifications approved by the Pla~ing Department. <br /> <br />2. That a 2 foot landscap~ pla=ter box be provided along the Baker Street <br /> frontage. <br /> <br />That the following conditions are to be cc~aplied with prior to the <br /> issuance of a building permit: <br /> <br />a. That the subdivider's e~gineer f~rnish the Department of <br /> Pmblic Works an on-site drainage flow plan showingthe <br /> direction and flow to adjacent streets when this property <br /> is developed. <br />b. That the subdivider's engineer furnish the Department of <br /> Public Works a final gradlngplan including existing <br /> elevations along the property lines. <br />c. That an easement be provided for a 15-foot radius property <br /> lir~ spandrel at the southeast corner of Second and Baker <br /> Streets. <br />NOTE: Dedication shall he initiated by owner, through the <br />Department of Public Works, at least two w~ prior to <br />application for a building pe~it to avoid delay. <br />d. That all elevations be on 1958 Orange County Survey Datum. <br />e. That all plans and surveys for the required improvements <br /> be completed by the owner's engineer and submitted to the <br /> Department of Public Works for approval. <br /> <br />4. The following condition is to be complied with prior to issuance of utilities <br /> release by the Building Department: <br /> <br />a. That the owner provide s~ltary sewer facilities to meet <br /> with the approval of the Department of Public Works. <br /> <br /> PASSED A~D ADOPTED BY the City Council of the City of Santa Aha at its <br />regular meeting held on the 8th day of September, 196~. <br /> <br />ATTEST: <br /> <br />CLERK OF 'r~i~ COUNCIL <br /> <br /> <br />
