RESOLUTION 64-153 AUTHORIZING CONDEMNATION OF <br />REAL PROPERTY NECESSARY FOR PUBLIC STREET <br />PURPOSES FOR THE APPROACH TO THE SANTA ANA <br />RIVER BRIDGE AT MCFADDEN AVENUE <br /> <br /> WHEREAS, the Master Plan for Streets and Highways approved <br />by the City Council on October 20, 1958, provides for the crossing <br />of the Santa Aha River by McFadden Avenue, an arterial street; and <br /> <br /> WHEREAS, the County of Orange is presently constructing a <br />bridge over said river to accomplish this crossing; and <br /> <br /> WHEREAS, it is necessary to acquire rights of way for public <br />street purposes to connect McFadden Avenue with said bridge, thereby <br />accomplishing the continuity of McFadden Avenue. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Aha hereby finds and determines that public interest <br />and necessity require the continuation of McFadden Avenue across the <br />Santa Aha River and further require that said City do have and acquire <br />as right of way for public street purposes, in fee simple, that <br />certain real property in the City of Santa Aha, County of Orange, <br />State of California, described as: <br /> <br />That portion of the West half of the East half of the <br />Northeast quarter of the Southwest quarter of Section 15, <br />in Township 5 South, Range 10 West, in the Rancho Las Bolsas, <br />in the City of Santa Aha, as shown on a map thereof, recorded <br />in Book 51, page 7, et seq., Miscellaneous Maps, records of <br />Orange County,bounded Easterly ilby the Channel of the Santa <br />Ana River as conveyed to the Newbert Protection District, <br />by deeds recorded November 18, 1910, in Book 194, page 168, <br />and in Book 194, page 169, of Deeds. <br /> <br />BE IT FURTHER RESOLVED: <br /> <br /> 1. That the City Attorney is hereby ordered to bring an <br />action in the name of the City to condemn said property necessary <br />to be taken and to do all things necessary to prosecute said action <br />to final determination; <br /> <br /> 2. That public interest, necessity and convenience require <br />and it is hereby ordered that said City take immediate possession <br />and use of the property herein ordered to be acquired upon compliance <br />with the requirements of law applicable thereto as a right of way <br />for public use; <br /> <br /> 3. That said public improvement is planned and located in <br />a manner which will be most compatible with the greatest public good <br />and the least private injury; <br /> <br /> 4. That the City of Santa Aha, a municipal corporation, is <br />authorized and empowered to provide for the opening, extension, <br />widening, construction and maintenance of public streets and highways <br />within the City; <br /> <br /> 5. That said action in condemnation shall be taken in <br />accordance with the provisions of the Code of Civil Procedure and <br />the Constitution of the State of California relating to eminent <br />domain. <br /> <br />-1- <br /> <br /> <br />
