161 <br /> <br /> ORDINanCE NO. 616. <br /> <br /> An Ordinance Regulating the Sale of Bread and <br />Establishing a Standard Weight thereof, in the City of Sa~ Ana <br />County of Orange, State of California. <br /> <br /> The Board of Trusteesof the City of Santa Ana, <br />do ordain as follows:- <br /> <br /> Section 1. The standard weight of all loaves <br /> <br />of bread known as milk, or white, rye or graham, and made or pro- <br />C~red for the purpose of sale, sold, offered for sale, or exposed <br />for sale in the City of Santa Ana, State of California, shall be <br /> <br />12 ounces, avoidrupois net weight, when baked, or regular multiples <br />of 12 ounces avoi~dupois net weight when baked. <br /> <br /> Section 2. It shall be unlawful for any person, <br />firm or corporation, to make or procure for the purpose of sale, <br />sell, offer or expose for sale, within the City of Santa Ana, State <br />of California, bread, the loaf or loaves of which is or are, not of <br />standard weight, as provided in Section i of this Ordinance. <br /> <br /> Section 3. Every person, firm or corporation, <br />who~shall make or procure for the purpose of sale, sell, offer or <br />expose for sale, any bread in said City of Santa Aha, whenever <br />requested by a buyer of bread, shall, in the presence of said buyer, <br />weigh the loaf,or loaves of bread. All inspections of the weight <br />of bread Ahall be made on the premises of the maker or manufacturer <br />and all weight of bread shall be determined by taking an average <br />weight of not less than twenty loaves. <br /> <br /> Section 4. The provisions o£ this Ordinance shall <br />not apply to crackers, pretzels, bisouit~, buns, scones, rolls or <br />loaves of fancy bread, weighing less than 1/4 of a pound avoi:dupois <br /> to what is commo$ known as stale bread, sold as such; provided, <br />or <br /> <br />the seller, shall, at the time of sale,expressly state to the buyer <br />that the bread so sold is stale bread. <br /> <br /> Section 5. Any person, firm or corporation, who <br />shall violate any of the provisions of this Ordinance shall be guilty <br />of a misdemeanor, and upon conviction thereof, shall pay a fine of <br />not less than ~lO,O0 or be imprisoned in the County Jail not more <br />than 100 days. <br /> <br /> Section 6. If any section, sub-sections, sentence, <br />clause or phrase of this Ordinance, is for any reason held to be <br />unconstitutional such decision shall not affect the validity, of the <br />remaining portions of this Ordinance in that the Board of Trustees <br />of the City of Santa Ana, declares that it would have passed this <br />Ordinance and each section, sentence, clause and phrase thereof <br />irrespective of the fact that any one or more of the sections, <br />sentences, clauses or phrases be declared unconstitutional. <br /> <br /> <br />
