144 <br /> <br /> westerly 47 feet more or less measured along the aforesaid norths <br /> erly line of alley from its intersection with the westerly line <br /> of Minnie Street; thence continuing across private property along <br /> last mentioned curve 156 feet more or less to the end of track. <br /> <br /> Section 2. The said railroad spur track shall at all <br />times conform as near as practicable to the official grads of said <br />streets as now established or may hereafter be established and that <br />the grantee of this franchise or its assigns shall at all times <br />keep the roadbed flush with the streets and provided with good and <br />suitable crossings and shall plank and macadamize the same between <br />the rails and if the streets shall be paved then with the same <br />material as the adjoining streets and for at least two feet on each <br />side thereof whenever and wherever ordered by the Board of Trustees <br />or other legislative body of said City so to do, and in the event <br />of a failure to comply with the requirements hereof for ten days <br />after notice so to do then the City will cause its Superintendent <br />of Streets to proceed to construct the required work iff a good and <br />substantial manner and the grantee of this franchise or its assigns <br />by acceptance hereof agrees to pay the cost therefor within thirty <br />days after the presentation of a bill for the same, and the gutters. <br />upon said streets shall be so constructed upon said streets as to <br />permit the passage of storm water along and under said track. <br /> <br /> Section 5. That within thirty days after the passage of <br />this Ordinance the grantee or its assigns shall file with the City <br />Clerk a written acceptance of this Ordinance and all of its terms, <br />conditions and requirements. <br /> <br /> Section 4. That no train, engine or car on the spur <br />track of said Con, any shall be left standing across said Minnie <br />and Walnut Streets and that said Company will not obstruct said <br />streets by any train, engine or car except when the same are in <br />motion. <br /> <br /> Section ~. The City Clerk shall certify to the passage of <br /> <br />this Ordinance and cause the same to be published once in the <br /> ? <br />"Evening Blade" a newspaper published and circulated in said City. <br /> <br /> The above Ordinance passed and adopted this ~4th day o£ <br />January,1918,'by the fo~lowing vote to-wit: <br /> <br />Maryatt,Visel, <br /> <br />Ayes, Trustees Tubbs, Greenleaf, <br /> <br />Noes Trustees,None. <br /> <br />Absent, Trustee McPhee. <br /> <br />A.J.Vieel, <br /> <br />President of the Board of Trustees <br /> of the City of Santa Ana,oal. <br /> <br /> <br />
