FOF INTO OR THE E~PORT~TION <br />· u~wOF OUT CF ?AID CITY FOR BEVERAGE PURPO~F$, E~CFPT A~ IN ~I~ <br /> ~E M,TI~ FOR ALL VIOLATIONS <br />THEPEOF. <br /> <br /> Th~ Board of Trus:=~s of ~he City of ,~t~ Aha ~o ordain as <br />follows: <br /> <br /> ~eot~on I- Whenever ~d wherever used in this Ordinano~ o~rtain <br />.words, terms and phrases shal~ mean ~d ~t all times be oonstrue~ <br />to h~v~ the meaning ~efined in this section. <br /> <br /> a- The wor~ "liquor" or the phrase "intoxicating liquor" ~hall <br /> <br /> be construed :o include alcohol, brady, whiskey, r~, gin, b~er, ale, <br /> ~ter and wine ~d in addition thereto, ~y s~lritou~, vinous, ma1: <br /> ~r f~rmen:ed liquor, iiquids aha comgounds, wh~her medicated, gro- <br /> prior.y, ~atented or not ~d by whatever n~me eal~ed containing one- <br /> half of one 9~r cent or more of a~ooho~ by ~o]~e which mrs fit for <br /> use for pevera~ purgose or ~hioh may be us=d for beverage purTose~. <br /> <br /> b- The term "wholesale druggist" shall mean one ~ho se~]s <br /> <br /> dru~s at wholesale a~d not to the g~neral ~ublio. <br /> <br /> o- The term "retail ~u~i~t "shall mean a registered ~'harmaoist, <br /> retail <br /> authorized to practice in this State, conducting a regul~/~usinees in <br /> drugs and who sells to the general public. <br /> <br /> d- The word "physician" shall mean a person who has a license <br /> <br /> to practice medicine ~der the laws cf the State of Califor'nia. <br /> <br /> e- The term "valid permit" shall mean a legal ~nrevoked permit to <br /> do the act or acts performed, issued by a commissioner, officer or agent <br /> of the United States, duly muthorJzed Oy the law thereof %o issue said <br /> <br />permit. <br /> <br /> Section 2- In the interpretation of t~, Or~Jinance, the words <br /> <br /> of singular number shall be deeme~ to include their plural and words <br /> <br />of a masculine gender shall be deemed to include the feminine and neuter <br />~'ender. The Word "person" shall be construed to mean and include natural <br />persons, firms, oO-partnershi?s, clubs an~ all associations or <br /> <br />binations of persons, whether acting by <br />agent or employee. <br /> <br /> Section 3. It shall be unlawful <br /> <br />themselves or by their <br /> <br />servant, <br /> <br />fOr any person directly or in- <br /> <br />directly to manufacture, ~ell, barter, deliver, furnish, provide, give <br />away or transport =_ny intoxicating liquor within the City cf Santa Aha <br />or to import any such liquor into'or export any such liquor from said <br />City, except as ~rovided herein and al! provisions of this Ordinance shall <br />be liberally construed to the end that the u~e of intoxicatin~ liquor <br />as a beverage in the City of Santo Ape shall be prevented =_nd prohibited. <br /> <br />Section 4- It shall be unlawful for any person while on or in <br />any public hi~jhway or public park or in a~ny vehicle or public conveyance <br /> <br />in any p'rivate <br />store or a <br /> <br />or other means of transportation or in ~ny club, hotel or <br />room or ,suite of rooms in an3~ club or hotel or theater'or <br /> <br /> <br />
