RESOLUTION 65--70 REVISING CONDITION (7) AND ADDING <br />CONDITION 10(b) TO VARIANCE GRANTED BY THE PLANNING <br />COmmISSION ON VARIANCE APPLICATION NO. 2089 FILED <br />BY G.L.A. DEVELOPMENT COMPANY <br /> <br /> WHEREAS, after public hearing on notice, the Planning Commis- <br />sion granted a variance on Variance Application No. 2089 filed by <br />G.L.A. DEVELOPMENT COMPANY to permit the construction of a gasoline <br />service station in an R-1 District at 1440 South Broadway, Santa Ana, <br />California; said Variance was granted subject to certain conditions; <br />and <br /> <br /> WHEREAS, Appeal Application No. 161 was duly filed by the <br />Department of Public Works of the City of Santa Ana appealing the <br />decision of the Planning Commission and presenting the matter before <br />the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, has <br />determined that said Variance Application meets the requirements of <br />Section 9250.8 of the Santa Ana Municipal Code and should be granted, <br />but that Condition No. (7) should be revised and Condition No. 10(b) <br />should be added to the conditions set forth by the Planning Commission <br />in their approval of said Variance. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the decision of the <br />Planning Commission to grant a variance on Application No. 2089 to <br />permit the construction of a gasoline service station at 1400 South <br />Broadway, Santa Ana, California, is approved subject to the following <br />conditions: <br /> <br />That a landscaping plan be submitted to and approved by the <br /> Planning Department, said landscaping shall be implemented <br /> and maintained; <br /> <br />2. That there be no major automobile repair on the premises; <br /> <br />3. That there be no storage of vehicles, trucks, trailers, or any <br /> equipment stored or sold on the property; <br /> <br />4. That signs and lights be located and oriented in such a manner <br /> as not to be obnoxious to surrounding residential properties; <br /> <br />5. That no banners, streamers or similar devices be displayed; <br /> <br />That no products be sold or stored, except those products <br /> normally and traditionally associated with the gasoline <br /> service station; <br /> <br />7. That development be according to revised plot plan; <br /> <br />That a six foot high ornamental style masonry wall be constructed <br /> between the subject property and any residentially used or <br /> zoned property; however, said wall shall not exceed three feet <br /> in height between the front property line and the established <br /> building line of the adjacent residential property; <br /> <br />e <br /> <br />That the proposed gasoline service station be of a non-metallic <br /> type and have either a rustic or residential design. The <br /> applicant shall submit the plans and renderings necessary for <br /> Planning Department approval. <br /> <br />10. That the following conditions be complied with prior to the <br /> issuance of a utility release: <br /> a) That the owner place solid sidewalk on Broadway; <br /> b) That Dedications and improvements on Edinger Avenue <br /> be according to plan on file in the Department of <br /> Public Works. <br /> <br />NOTE: <br /> <br />The Municipal Code states the maximum frontage of a lot <br />permitted to be a driveway shall be 50 per cent.
