RESOLUTION 65-79 AUTHORIZING CONDEMNATION OF AN <br />EASEMENT FOR STREET PURPOSES FOR EDINGER AVENUE <br /> <br /> WHEREAS, due to the rapid population growth the existing <br />demand for vehicular traffic ways and the anticipated growth in <br />east-west traffic in the southerly part of Santa Ana require that <br />Edinger Avenue be extended easterly between Grand Avenue and the <br />Southern Pacific Railroad right of way. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana does hereby find and declare that public <br />interest and necessity require the acquisition of a right of way <br />for all the purposes of a public street in, through, and over that <br />certain land in the City of Santa Ana, County of Orange, State of <br />California, described as: <br /> <br />An easement for street purposes over the following described <br />property: <br /> <br />Commencing at the intersection of the center lines of Grand <br />Avenue and McFadden Avenue as shown on a Record of Survey map <br />recorded in Book 50, page 19, of Record of Surveys in the Office <br />of the County Recorder of Orange County, California, and running <br />thence South 00° 34' 07" West along said center line of Grand <br />Avenue 2505.38 feet; thence North 89° 22' 33" West 30.00 feet to <br />the TRUE POINT OF BEGINNING and to a point herein referred to as <br />point A; thence continuing North 89° 22' 33" West 1149.48 feet, <br />more or less, to the Easterly line of the right of way of the <br />Santa Ana and Newport Railway Company (now Southern Pacific <br />Railroad Company) and to a point herein referred to as point B; <br />thence South along the Easterly line of said right of way 20.00 <br />feet; thence South 89° 22' 33" East 40.00 feet to a point; thence <br />Northeasterly to a point that is 15.00 feet Southerly and 240.00 <br />feet Easterly of point B; thence South 89° 22' 33" East 666.48 <br />feet to a point that is 243.00 feet West and 15.00 feet Southerly <br />of point A; thence Southeasterly to a point that is 143.00 feet <br />West and 20.00 feet Southerly of point A; thence South 89° 22' 33" <br />East 133.00 feet; thence Southeasterly to a point that is on the <br />Westerly line of Grand Avenue and 30.00 feet Southerly of point A; <br />thence North along the Westerly line of Grand Avenue 60.00 feet; <br />thence Southwesterly to a point that is 10.00 feet Westerly and <br />20.00 feet Northerly of point A; thence North 89° 22' 33" West <br />133.00 feet to a point that is 143.00 feet Westerly and 20.00 <br />feet Northerly of point A; thence Southwesterly to a point that <br />is 243.00 feet Westerly and 15.00 feet Northerly of point A; thence <br />North 89° 22' 33" West 666.48 feet; thence Northwesterly to a <br />point that is 40.00 feet Easterly and 20.00 feet Northerly of <br />point B; thence north 89° 22' 33" West 20.00 feet to the Easterly <br />line of the right of way of the Santa Ana and Newport Railway <br />Company(now Southern Pacific Railroad Company); thence South <br />along the Easterly line of said right of way 20.00 feet to said <br />point B; thence South 89° 22' 33" East 1149.48 feet, more or <br />less, to point A and to the Point of Beginning. <br /> <br />BE IT FURTHER RESOLVED: <br /> <br /> 1. That the City Attorney is hereby ordered to bring an <br />action in the name of the City of Santa Ana to condemn said property <br />necessary to be taken and to do all things necessary to presecute <br />said action to final determination; <br /> <br /> 2. That the City is authorized and empowered to acquire, <br />locate, construct, repair, and maintain public streets within the <br />City; <br /> <br /> 3. That said public improvement is planned and located in <br />a manner which will be most compatible with the greatest public good <br />and the least private injury; <br /> <br />-1- <br /> <br /> <br />
