RESOLUTION 65-80 APPROVING MAP AND DECLARING <br />INTENTION TO VACATE A 10-FOOT SURPLUS RIGHT OF <br />~Y AT THE SOUTHEAST CORNER OF McFADDEN AVENUE <br />AND SULLIVAN STREET, RESERVING AN OVERHANG <br />EASEMENT THEREIN, AND GIVING NOTICE OF HEARING <br />THEREON <br /> <br /> WHERF2%S, on recommendation of the Planning Department and <br />the Department of Public Works for vacation of street easement <br />dedicated by the property owner and now declared to be surplus, it <br />has been determined that said street easement should be returned <br />to the property owner. <br /> <br /> NOW, THEREFORE, B~ IT RESOLVED: That the City Council hereby <br />approves the map attached hereto and orders the same filed with the <br />original of this Resolution in the office of the Clerk of the Council, <br />declares its intention to proceed with this vacation under the <br />provisions of the Street Vacation Act of 1941 (§8300 through §8374 of <br />the California Streets and Highways Code) to vacate a portion of <br />street right of way on the south side of McFadden Avenue, east of <br />Sullivan Street, and reserving therein an overhang easement for <br />transmission of electrical energy and electrical ccaumunication for <br />the Southern California Edison Company. Said easement lies in the <br />City of Santa Aha, County of Orange, State of California, and is <br />described as: <br /> <br />Those portions of lots 1 and "X" in Block "A" of Tract No. 604, <br />in the City of Santa Aha, County of Orange, State of California, <br />as per map recorded in Book 24, Page 19 of Miscellaneous Maps, <br />in the office of the County Recorder of said County, lying <br />northerly of the following described line: <br /> <br />Beginning at the intersection of the East line of said Lot 1 <br />with the South line of the North 10.00 feet of said lots; thence <br />West along said South line to a point East 15.00 feet from the <br />West line of said lot "X"; thence southwesterly on a direct line <br />to a point on the West line of said lot "X" southerly 15.00 feet <br />from the northwest corner thereof. <br /> <br />EXCEPT that portion thereof lying northwesterly of a curve <br />concave southeasterly having a radius of 25.00 feet which is <br />tangent to the West and North lines of said land. <br /> <br /> BE IT FURTHER RESOLVED: That June 21, 1965, at the hour of <br />7:30 P.M. in the Council Chambers, City Hall, Third and Main Streets, <br />Santa Aha, California, is hereby fixed as the time and place for <br />hearing all persons interested in or objecting to said proposed <br />street vacation. <br /> <br /> The Clerk of the Council is hereby ordered to publish this <br />Resolution once in The Register and the Director of Public Works is <br />ordered to post notices of street vacation conspicuously along the <br />line of said streets stating the passage of this Resolution of <br />Intention to vacate and the time and place of hearing thereon. Said <br />notices shall be posted not more than 300 feet apart and at least <br />three such notices shall be posted. Both publication and posting <br />shall be completed at least ten days before the date of said hearing. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 17th day of May, 1965. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br /> <br />
