RESOLUTION NO. <br /> <br /> RESOLUTION PROVIDING FOR LIQUIDATED DAMAGES <br /> ASSESSMENT DISTRICT NO. 229, SANTA ANA, <br /> CALIFORNIA <br /> <br /> BE IT RESOLVED by the City Council of the City of Santa <br />Ama, California, in regular session assembled this 2nd day of <br />August, 1965, that in the event the contractor awarded the contract <br />for the doing of the work and making the improvements in this im- <br />provement district does not complete said work and improvements <br />within the tim~ limit specified in the contract for the doing of <br />said work and making said improvements, or within such further time <br />as this City Council shall have authorized, then and in that event <br />said contractor shall pay to said City of Santa Ama liquidated <br />damages in the amount of $40.00 per day for each and every day's <br />delay beyond the aforesaid time of completion of said work and <br />improvement s. <br /> <br /> BE IT FURTHER R~SOLVED that the specifications for the <br />doing of said work and making said improvement shall contain pro- <br />visions in accordance herewith. <br /> <br /> BE IT FURTHER RESOLVED that any monies received by said <br />city on account of such liquidated damages shall be applied as <br />follows: <br /> <br /> 1. If received prior to confirmation of the assessmant <br />herein, such monies shall be applied as a contribution against the <br />assessment. <br /> <br /> 2. If received after the confirmation of the assessment, <br />such monies shall be applied in the manner provided in Section <br />5132.1 of the Streets and Highways Code of the State of California <br />for the disposition of excess acquisition funds. <br /> <br /> 3. If a contribution has theretofore been made or ordered <br />by any agency, other than this city, then a refund shall be made <br /> <br />-1- <br /> <br /> <br />
