Board of Trustees and present any objection which they may have to <br /> said proposed set-back line or lines as set f~th in said re~lutiol <br /> of intention. Said time of hearing shall not be less than fifteen <br /> (15) or more than forty (40) days from the date of the a~ption of <br /> the resolution of intention; and said publication and p~ ting of <br /> said resolution shall be made at least ten (10) days before the <br /> time of sai~ hearing. <br /> <br /> Section 4. After the adoption of said resolution of <br /> <br />' intention, and prior to the time the ordinance establishing a set- <br /> back line or lines in such p~oceedings becomes effective, no <br /> building permit shell be issued for the erection of any building or <br /> structure between any proposed set-back line and the street line, <br /> and any permit so issued shall be void. <br /> <br /> Section 5. At any time not late~· than the hour set f~ <br /> hearing objections and protests to the establishment of the pro- <br /> p~ed set-back line or lines any person having any interest in any <br /> land upon which $~Id set-back line is proposed to be established, <br /> may file with the City Clerk a written protest or objection against <br /> the establis.bment of said set-back line or lines designated in the <br /> resolution of intention. Such protest must be in writing an8 be <br /> delivered to said Clerk not later than the hour set for said hear- <br /> ing, and no other protests or objections shall be considered. <br /> All protestants may appear before the Board of Trustees at said <br /> hearing, either in person or by co,n~sel, and be heard in support <br /> of their protests or objections. At the time set for hearing, <br /> or at any time to which the said h~aring may be continued, the <br /> Board of Trustees shall proceed to hear and pass upon all protests <br /> or objections so made, and its decision shall be final and conclusi <br /> <br /> Said Board of Trustees sh~l have p~.er and Juris~ction <br /> to sustain any protest or ob.]ection and abandon said proceedir~, <br /> or to deny an~f and all protests or objections, and order by <br /> ordinance the establishment of said set-back line or lines <br /> described in the resolution of intention~ or to ~.der the same <br /> established with such changes or modifications aS the Board of <br /> Trustees may deem proper. <br /> <br /> Section 6. From and after the taking effect of such <br /> ordinance establishing any set-back line or lines, it shall be un- <br /> lawful for any persdn, firm or corporation to construct any <br /> building, wall, fence or other structure within the s~ ce between <br /> the street line and the set-back line, so established, and the <br /> Building Inspector shall refuse to iss~ any perm~.t for any <br /> building or structure to be erected within such space. <br /> <br /> Section 7. Any person, fir~ or corporation violating any <br /> of the provisions of any ordinance establishing any set-back line <br /> pursuant to this c~dinance, shell be deemed guilty of a misdemeanor <br /> <br /> <br />
