RESOLUTION 65-127 OVERRULING THE DECISION OF <br />THE PLANNING COMMISSION AND GRANTING CONDITIONAL <br />USE PERMIT NO. 198 TO LEO ROVIN, SUBJECT TO <br />CONDITIONS <br /> <br /> WHEREAS, after hearing on notice, the Planning Cc~unission <br />DENIED a request for Conditional Use Permit No. 198 filed by <br />LEO ROVIN to construct and operate a psychiatric hospital in an <br />M-1 District, and Appeal Application No. 164 was duly filed by <br />said applicant presenting the matter to the City Council; ;and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, <br />has determined that said Conditional Use Permit meets the require- <br />ments of Section 9250.8 of the Santa Aha Municipal Code; that the <br />decision of the Planning C~t~,,ission should be overruled; and that <br />said Conditional Use Permit should be granted subject to applicable <br />conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Aha does hereby overrule the decision of the Planning <br />Con~nission and does hereby grant Conditional Use Permit No. 198 to <br />allow the construction and operation of a psychiatric hospital in <br />the M-1 District, approximately 100 feet east Of 3313 South Main <br />Street, Santa Aha, California. Said Conditional Use Permit is <br />granted subject to the following applicable conditions: <br /> <br />1. That development be according to plot plan, except for minor <br />modifications approved by the Planning Department; <br /> <br />That a six (6) foot high concrete block or masonry wall be <br /> constructed along the north, east, and west property lines, <br /> except in the required twenty (20) foot setback where the <br /> wall shall be stepped to a height of forty-two (42) inches. <br /> <br />e <br /> <br />That landscaping shall be provided in accordance with a land- <br /> scape plan to be submitted to and approved by the Planning <br /> Department; such landscaping shall be continuously maintained. <br /> <br />4. The following conditions are to be c~nplied with prior to the <br /> issuance of a building permit: <br /> <br />a.) An on-site drainage flow plan be submitted. <br /> <br />b.) The subdivider must submit street improvement plans <br /> for Columbine Street. <br /> <br />c.) Ail elevations are to be on 1958 Orange County Survey <br /> Datum. <br /> <br />d.) Ail plans and surveys for the required improvements are <br /> to be completed by the owner's engineer and submitted <br /> to the Department of Public Works for approval. <br /> <br />Sm <br /> <br />The following conditions are to be cemplied with prior to the <br /> issuance of utilities release by the Department of Building <br /> Safety and Housing: <br /> <br />a.) The owner is to provide sanitary sewer facilities to <br /> meet with the approval of the Department of Public Works. <br /> <br />The owner is to place curb, gutter and sidewalk and pave <br />up to center line on Columbine Street. The new curb and <br />gutter to be placed twenty (20) feet north of the center <br />line of Columbine Street. <br /> <br />-1- <br /> <br /> <br />
