RESOLUTION 65-128 APPROVING MAP AND DECLARING <br />INTENTION TO VACATE A 14-FOOT ALLEY BETWEEN <br />MAIN AND CYPRESS, SOUTH OF BISHOP, RESERVING <br />AN EASEMENT THEREIN FOR PUBLIC UTILITIES, AND <br />GIVING NOTICE OF HEARING THEREON <br /> <br /> WHEREAS, the Public Works Department and the Planning Depart- <br />ment have joined with the owner of adjacent property in requesting <br />the vacation of an alley as shown on the map of Johnson's Addition <br />to Santa Aha. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council hereby <br />approves the map attached hereto and orders the same filed with the <br />original of this Resolution in the office of the Clerk of the Council, <br />and reference is hereby made to said map for the exterior boundaries <br />of said right of way proposed to be vacated. <br /> <br /> The City Council declares its intention to proceed under the <br />provisions of tt~ Street Vacation Act of 1941 (§8300 through ~8374 <br />of the California Streets and Highways Code) to vacate that certain <br />alley right of way running north and south between Main Street and <br />Cypress Avenue, south of Bishop Street and reserving therein easements <br />for utility structures for the Pacific Telephone Company and the <br />Southern California Edison Company. Said alley right of way proposed <br />to be vacated lies in the City of Santa Ana, County of Orange, State <br />of California, and is described as: <br /> <br />That certain alley, 14.00 feet in width, as shown on the <br />map of Johnson's Addition to Santa Ana, recorded in Book 26, <br />Page 55, of Miscellaneous Records of Los Angeles County, <br />California; <br /> <br />RESERVING AND EXCEPTING from said street vacation an easement <br />and right of way for the Pacific Telephone Company in and over <br />the westerly eight (8) feet of the easterly twelve (12) feet <br />of that certain alley next hereinabove described for all the <br />purposes of installing, constructing, altering, adding to, <br />maintaining, replacing, and inspecting above-ground or <br />under-ground poles, guys, markers, wires, cables, or other <br />appliances necessary for the carrying on of the business of <br />said utility company; <br /> <br />AND RESERVING AND EXCEPTING from said street vacation an <br />easement and right of way for the Southern California Edison <br />Co~apany in and over the easterly five (5) feet of that <br />certain alley next hereinahove described for all the purposes <br />of installing, constructing, altering, adding to, maintaining, <br />replacing, and inspecting above-ground or under-ground poles, <br />guys, markers, wires, cables, or other appliances necessary <br />for the carrying on of the business of said utility company. <br /> <br /> BE IT FURTHER RESOLVED: That these proceedings are taken <br />subject to the reservations and exceptions next hereinabove set out. <br /> <br /> BE IT FURTHER RESOLVED: That September 20, 1965, at the hour <br />of 7:30 P.M. in the Council Chambers, City Hall, Third and Main Streets, <br />Santa Ana, California, is hereby fixed as the time and place for <br />hearing all persons interested in or objecting to said proposed <br />street vacation. <br /> <br />-1- <br /> <br /> <br />
