RESOLUTION 65-129 ACCEPTING DEEDS, AN OFFER OF
<br />DEDICATION, AND AN INDENTURE, ALL WITH NO CASH
<br />CONSIDERATION, AND AUTHORIZING EXECUTION OF
<br />AMENDMENT TO ESCROW INSTRUCTIONS
<br />
<br /> WHEREAS, BANK OF AMERICA NATIONAL TRUST AND SAVINGS ASSOCIATION,
<br />a national banking association, has delivered to the City a deed dated
<br />June 25, 1965, conveying an easement for street purposes at the
<br />southwest corner of Ninth and Bush Streets and an easement for street
<br />purposes at the northwest corner of Eighth and Bush Streets; and
<br />
<br /> WHEREAS, KENNETH C. TUCKER and LOIS R. TUCKER have delivered
<br />to the City a deed dated August 3, 1965, conveying vehicular access
<br />rights to Fifth Street, west of the Santa Aha River; and
<br />
<br /> WHEREAS, FREDERICK R. SACHER and RUTH F. SACHER have delivered
<br />to the City a deed dated July 28, 1965, conveying an easement for
<br />water main purposes for Stevens Avenue, 372 feet east of Main Street;
<br />and
<br />
<br /> WHEREAS, FRED R. CERMAK and FLORENCE S. CERMAK have delivered
<br />to the City two (2) deeds dated August 5, 1965, conveying easements
<br />for street purposes at the southwest corner of Bristol and Walnut
<br />Streets, and an Offer of Dedication dated August 5, 1965, for alley
<br />purposes at the southwest corner of Bristol and Walnut Streets, said
<br />Offer of Dedication to expire on May 19, 1975, unless previously
<br />accepted by the City; and
<br />
<br /> WHEREAS, SOUTHERN PACIFIC COMPANY, a corporation of the State
<br />of Delaware, has delivered to the City an Indenture dated July 13,
<br />1965, granting an easement for Edinger Avenue across the Southern
<br />Pacific Company's Santa Aha-Dyer line; and
<br />
<br /> WHEREAS, all of said instruments are without cash consideration
<br />being paid to said grantors by the City;
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ana
<br />accepts said instruments and Carl J. Thornton, the City's designated
<br />agent, is directed to place his Certificate. of Acceptance on said
<br />instruments.
<br />
<br /> BE IT FURTHER RESOLVED: That the Mayor is hereby authorized
<br />to sign the Amendment to Instructions to Escrow No. 52781-C in
<br />connection with an exchange of properties between JULIA M. STILLINGS
<br />and the City of Santa Ana.
<br />
<br /> PASSED AND ADOPTED by the City C~u~ncil of the Ci~,y7of Santa
