RESOLUTION 65-1~7 AUTHORIZING CONDEMNATION <br />OF EASEMENT FOR STREET PURPOSES FOR THE <br />EASTERLY EXTENSION OF EDINGER AVENUE ACROSS <br />THE PACIFIC ELECTRIC RAILROAD <br /> <br /> WHEREAS, the rapid population growth in the City of Santa Ana <br />and the increased vehicular traffic require that Edinger Avenue be <br />opened between Maple Street and Standard Avenue. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Aha hereby finds and declares that the public interest <br />and necessity require the acquisition of rights of way for all the <br />purposes of a public street in, through, and over certain parcels of <br />real property in the City of Santa Aha, County of Orange, State of <br />California, described as: <br /> <br />An easement for street purposes over that section of the Pacific <br />Electric Railway 40-foot wide right of way described as follows: <br /> <br />PARCEL 1: A strip of land 50 feet in width, being 25 feet on <br /> each side of the following described center line: <br /> <br />Beginning at a point on the west line of the Pacific <br />Electric Railway right of way which is 24 feet <br />northerly, measured along said west line, from the <br />intersection of said west line with the center line <br />of Edinger Street as shown on a map of Tract No. 252 <br />recorded in Book 13 at Page 33, Miscellaneous Maps, <br />records of Orange County, California, and running <br />thence easterly along the easterly extension of said <br />center line of Edinger Street 40 feet to the east line <br />of said Railroad right of way. <br /> <br />PARCEL 2: <br /> <br />A spandrel shaped parcel of land bounded northerly <br />by the south line of Parcel 1, bounded westerly by <br />said west line of the Railroad right of way, and <br />bounded southeasterly by the arc of a curve concave <br />southeasterly, having a radius of 15 feet and tangent <br />to said northerly and westerly boundaries. <br /> <br />BE IT FURTHER RESOLVED: <br /> <br /> 1. That the City Attorney is hereby ordered to bring an <br />action in the name of the City of Santa Aha to condemn said property <br />necessary to be taken and to do all things necessary to prosecute <br />said action to final determination; <br /> <br /> 2. That the City of Santa Aha is authorized and empowered <br />to acquire, develop, maintain, improve, and repair streets within <br />the City; <br /> <br /> 3. That said public improvement is planned and located in <br />a manner which will be most compatible with the greatest public good <br />and the least private injury; <br /> <br /> 4. That said action in condemnation shall be taken in accord- <br />ance with the provisions of the Code of Civil Procedure and the <br />Constitution of the State of California relating to eminent domain. <br /> <br /> 5. That public interest, necessity, and convenience require, <br />and it is hereby ordered, that said City take immediate possession <br />and use of the property herein ordered to be acquired for street <br />purposes upon compliance with the requirements of law applicable <br />thereto as rights of way for public street. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 20~h day of September, 1965. <br /> <br />CLERK OF THE COUNCIL <br /> <br /> <br />
