RESOLUTION 65-179 A~£HORIZING CONDemNATION OF <br />AN EASemENT FOR STP~EET PURPOSES ON THE NORTH <br />SIDE OF EIGHTH STREET, WEST OF BRISTOL STREET <br /> <br /> WHEREAS, the rapid expansion of the Civic Center area of the <br />City and the continuing increase in traffic volume has made it <br />necessary to widen Eighth Street to provide for the present and <br />prospective traffic demands; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Ana does hereby find and determine that the public <br />interest and necessity require that Eighth Street be widened on the <br />north side, west of Bristol Street,and does require that said City <br />do have and acquire an easement for street purposes in, over, through <br />and across that certain real property in the City of Santa Ana, <br />County of Orange, State of California, described as: <br /> <br />That portion of the Northeast quarter of the Southeast quarter of <br />Section 11, Township 5 South, Range 10 West, San Bernardino Base <br />and Meridian, in the City of Santa Ana, described as follows: <br /> <br />Commencing at a point 40.60 chains South of the common corner of <br />Sections 1, 2, 11, and 12, Township 5 South, Range 10 West, <br />San Bernardino Base and Meridian, thence West 263.45 feet; thence <br />South 363.92 feet to the true point of beginning; thence East <br />46.24 feet to the beginning of a tangent curve concave South- <br />westerly, having a radius of 1,040.00 feet; thence Southeasterly <br />along the arc of said curve through a central angle of 0° 28' 57" <br />an arc distance of 8.76 feet to a point on a non-tangent line; <br />thence South 39.63 feet to the center line of Eighth Street as <br />shown on Tract 662, recorded in Book 24, Page 17, Miscellaneous <br />Maps, records of Orange County, California; thence Westerly <br />55 feet along said center line of Eighth Street; thence North <br />40 feet to the true point of beginning. <br /> <br />EXCEPTING '~HE~EFROi~ that portion previously dedicated for street <br />purposes. <br /> <br />BE IT FURTHER RESOLVED: <br /> <br /> 1. That the City Attorney is hereby ordered to bring an action <br />in the name of the City of Santa Ana to condemn said property <br />necessary to be taken and to do all things necessary to prosecute <br />said action to final determination; <br /> <br /> 2. That the City of Santa Ana is authorized and empowered to <br />acquire, develop, maintain, improve, and repair streets within the <br />City; <br /> <br /> 3. That said public improvement is planned and located in a <br />manner which will be most compatible with the greatest public good <br />and the least private injury; <br /> <br /> 4. That said action in condemnation shall be taken in <br />accordance with the provisions of the Code of Civil Procedure and <br />the Constitution of the State of California relating to eminent domain; <br /> <br /> 5. That the public interest, necessity, and convenience <br />require, and it is hereby ordered, that said City take immediate <br />POSSeSsion and use of the property herein ordered to be acquired <br />upon compliance with the requirements of law applicable thereto as <br />right of way for public street. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 15~h day of November, 1965. <br /> <br />CLERK OF THE COUNCIL <br /> <br /> <br />
