ORDINANCE NO. 908 <br /> <br /> AN ORDINANCE GRANTING PACIFIC ELECTRIC RAILWAY <br /> COMPANY, A CORPORATION, AUTHORITY TO CONSTRUCT <br /> AND FOR A PERIOD OF FIFTY YEARS TO MAINTAIN AND <br /> OPERATE TROLLEY WIRES ~ND OTHER WIRES UPON POLES <br /> AND FIXTURES TO BE ERECTED ALONG THIRD STREET <br /> BETWEEN LACY STREET AND MAPI~E STREET IN THE CITY <br /> OF SANTA ANA, CALIFORNIA. <br /> <br /> WHEREAS, the Pacific Electric Railway Company~ a corporation, now main- <br /> tains an electric railroad system in the City of Santa Aha using as a motive power <br /> therefore electricity, which power is conducted on lines supported upon poles <br /> constructed on and along certain public streets in the City of Santa Ana, State of <br /> California, one of which pole lines is now maintained and operated along First <br /> Street between Lacy Street and Maple Street in the City of Santa Aha, State of <br /> California, and <br /> <br /> WHEREAS, it is the desire of the City of Santa Aha to have said pole <br /> line removed from First Street because of the widening and improvement of said <br /> First Street. <br /> <br /> NOW, THEREFORE, the Board of Trustees of the City of Santa Ana does <br /> ordain as follows: <br /> <br /> Section 1. That peEnission be and the same is hereby granted to Pacific <br /> Electric Railway Company to construct, and for a period of Fifty (50) years to <br /> maintain and operate its trolley wires, trolley suspension wires, trolley feeder <br /> cables, transmission wires~ telephone wires and other wires or adjuncts necessary <br /> and convenient for the operation of its railway, supported upon poles and fixtures <br /> to be constructed adjacent to and back of the south curb or curb line of Third <br /> Street over the following described route, to-wit: <br /> <br /> Beginning at the Westerly side of Lacy Street and running Westerly <br /> therefrom along the Southerly side of Third Street for a distance of <br /> 817 feet. <br /> <br /> Section 2. The above rights and privileges are granted upon the express <br />condition that the work upon said pole line shall be begun w~t~hin~ ~our (4) months <br />of the taking effect of this ordinance and continued diligently thereafter and in <br />good faith and shall be completed within twelve (l~) months thereafter. <br /> <br /> ~ection 2- The grant of this franchise is effective only upon the <br />further condition that the grantee within five (5) days after said franchise is <br />awarded to it shall file with the said Board of Trustees a bond running to said Cit <br />in the penal stun of One Thousand ($1,000.00) dollars with at least two good and <br />sufficient su~eti~s~ to be approved by said Board of Trustees c~nditioned that sai~ <br />grantee shall well and truly observe, fulfill and perform each and every term and <br />condition of such bond the whole amount of the penal stun therein ns~ued shall be <br />taken and deemed to be liquidated damages and shall be recoverable from the <br />principal and sureties upon said bond. If said bond be not so filed the award <br />o£ said franchise shall be set aside and any money paid therefore will be forfeite~ <br /> <br /> Section 4. That said grantee, its successors or assigns are hereby <br />required to file a written acceptance of the terms and conditions thereof with the <br />Clerk of said City within thirty (30) days after the passage of this Ordinance. <br /> <br /> Section 5. That the City Clerk shall certify to the passage of this <br />ordinance and shall cause the same to be published once in the Santa Ana Daily <br />Register, a newspaper published in the City of Santa Aha. <br /> <br /> <br />
