ORDINANCE NO. 948 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA~ A~NDING <br />SECTION 67 of ~RDINANCE NO. 658, AS AMENDED BY <br /> ORDINANCES NO. 710 and 771. <br /> <br /> The~ Board ofTrustees of the City of Santa Ana do ordain as follows: <br /> <br /> SECTION 1.~ That Section 67 of Ordinance 658 as amended by Ordinance No. 710 <br /> and No. 771, is hereby amended to read as follows: <br /> <br /> SECTION 67. Every person, firm. or corporation engaged in the business <br /> <br /> or occupation of a solicitor, $5.00 per day for each solicitor. <br /> <br /> A "solicitor" within the meaning of this ordinance is defined to be any <br /> person who goes from house to house or from place to plach in the City of Santa Ana, <br /> selling or taking orders, or offering to sell or take orders for goods, wares or <br /> merchandise, or any article for future delivery, or for service to be performed in the <br /> future, or for the making, manufacturing or repairing of any article for future delivery. <br /> <br /> Any person seeking a license to engage as a solicitor within the City of <br /> Santa Aha shall make application therefor to the City Clerk on forms to be provided, <br /> stating the name and address of the applicant, the kind of goods offered for sale, or <br /> the kind of service to be performed. Such application shall be accompanied by either <br /> cash in the sum of $500.00, or a bond in the sum of $500.00, executed by the bounden <br /> principal and any reliable surety company in favor of said City of Santa Aha, and shall <br /> <br />enure to the benefit of the City of Santa Aha and to any person or persons and to all <br /> employors of said licensee. .The conditions of this bond shall be stated in <br /> substantially the following language: Such bond shall be conditioned upon the making of <br /> final delivery of the goods ordered or services to be performed in accordance with the <br /> terms of such order, or failing therein, that the advance payment on such order be <br /> refunded. <br /> <br /> Any person aggrieved by the action of any such solicitor shall have the right <br /> of action on the bond for the recovery of money or damages, or both. Such bond shall <br /> remain in full force and effect for a period of ninety (90) days after the expiration <br /> of any such license, and in ca~e of a cash deposit such deposit shall be retained by <br /> the City of Santa Aha for a like period of ninety days after the expiration of any such <br /> license. <br /> <br /> This section shall not apply to any employee, agent or representative of any <br /> person~ firm or corporation that is paying a vocational tax to the City of Santa Ana as <br /> specified in any other section of this ordinance. <br /> <br /> SESSION 2. All ordinances or parts of ordinances as the same affect this <br /> ordinance, are to that extent repealed. <br /> <br /> SECTION 3. The City Clerk shall certify to the passage of this ordinance and <br /> cause the same to be published three times in the "Santa Ana Daily Evening Register", a <br /> daily newspaper printed, published and circulated in the City of Santa Aha, and said <br /> ordinance shall take effect thirty (30) days from the date of its final passage. <br /> <br /> The foregoing orSinance is approved this 19th day of October, 1931. <br /> <br />ATTEST: <br /> <br /> E.
