<br />AN ORDINANCE OF THE CITY OF SANTA ANA LICENSING
<br /> THE OCCUPATION OF TRANSIENT MERCHANTS.
<br />
<br /> The Board of Trustees of the City of Santa Ana ordains as follows:
<br />
<br /> SECTION l: For any person, firm or corporation engaging in the business of a
<br />"transient merchant" in the City of Santa Aha, $5.00 per day.
<br />
<br /> SECTION 2: The words "transient merchant", as used in this ordinance, shall
<br />be deemed to mean and include any person or persons, either principal or agent,
<br />employer or employee, who engages in a temporary business in the City of Santa Aha by
<br />selling or offering for sale goods, wares or merchandise for a period of not more than
<br />ninety (90) days, and who, for the purpose of carrying on such business, hires, leases,
<br />or occupies any room, building, structure or stand on any real property, or on or adjoin
<br />ing any street or public place in the City of Santa Aha. The person, firm or corporati
<br />so engaged shall not be relieved from the provisions of this ordinance by reason of
<br />associating temporarily with any local dealer, trader, merchant or auction~or, or by
<br />reason of conducting such temporary business in connection with, or as a part of any loc
<br />business, or, in the name of any local dealer, trader, m~rchant or auctioneer.
<br />
<br /> SECTION 3: Every parson, firm or corporation before engaging in, or setting
<br />up, any business or occupation in the City of Santa Aha for the purpose of selling or
<br />offering for sale any goods, wares or merchandise in any room, building, structure, or
<br />stand on real property, or on or adjoining any street or public place, hired, lea~ed,
<br />or occupied by him or it, shall first make written application to the City Clerk of the
<br />City of Santa Ana on forms provided for this purpose for a license so to do.
<br />
<br /> (1) The forms specified in the paragraph next preceding shall contain certain
<br /> information of a nature indispensable to the Clerk of the City of Santa Aha in the
<br /> conduct of his office.
<br />
<br /> SECTION 4: The provisions of this Section shall nob apply bo businesses where
<br /> the saIe of goods, wares Or merchandise is incidental to the performance of a service,
<br /> and the gross monthly income is $300.00 or less, 60% or more of which is represented by
<br /> labor.
<br />
<br /> (1) The provision of this Ordinance shall not apply to commercial travelers
<br /> or selling agents, selling their goods to dealers for the ?urpose of res'ale, whether
<br /> selling for present or future deliveries by sample or otherwise, nor to persons selling
<br /> fruit, vegetables, butter, eggs, or other farm or ranch products raised or produced by
<br /> themselves.
<br />
<br /> SECTION 8: That Section 78 of Ordinance 688 relative to itinerant vendors or
<br /> transient merchants and amendments thereto, be, and the s~ne is hereby repealed.
<br />
<br /> SECTION 6: The City E~erk shall certify to the passage of this ordinmnce and
<br /> cause the same to be published three (3) times in the Santa Ana Daily Evening Eegister,
<br /> a daily newspaper printed and published and circulated in the City of Santa Aha, and the
<br /> same shall take effect and be in force thirty (30) days from its final passage.
<br />
<br /> The foregoing Ordinance is approved this 3rd day of January, 1933.
