<br /> AN ORDINANCE RELATING TO AiID PROVIDING[FOR THE
<br /> LEVY ~ A LICENSE TAX UPON AND REGULATING THE
<br /> BUSINESS G~ PORTRAIT AND COMMERCIAL PHOTOGRAPHY,
<br /> AND THE CA~WASSING AND TAKING ORDERS FOR~ THE
<br /> MAKING. ENLARGING~ COPYING, AND COLORING OF
<br /> PICTURES, FRAMING AND PHOTOGRAPHERS WITHIN THE
<br /> CITY OF SANTA ANA, CALIFORNIA, AND PR~ DDING
<br /> PENALTIES FOR THE VIOLATION THEREOF.
<br />
<br />The City Counci$ of the City of Santa Aha ordains as follows:
<br />SECTION l. That there is hereby levied upon each person, firm or
<br />occupation engaged in th%business~ profession, trade or occupation of portrait or
<br />commercial photography within the Ciby of Santa Aha, California, an annual license
<br />fee of $12.00 per year, payable in advance.
<br />
<br /> SECTI0~ 2. That there is hereby levied upon each person, firm or corp-
<br />oration, either as princip~, agent or employee, engaged in the business, pro-
<br />fession, trade or occupatiol~ of canvassing, soliciting, or taking'orders within
<br />the City of Santa Ana, California, for the making of portraits~ pictures, kodak
<br />finishing or photographs, or copying, framing or enlarging the same, au annual
<br />license tax of ~12.00, payable each year in advance; that each and every person,
<br />either as principal~ agent.or employee~ soliciting as aforesaid, shall be
<br />required to procure a separate license; PROVIDED~ that no person, firm or corp-
<br />oration operating under the provisions of this ordinance shall issue coupons and/e~
<br />merchant's certificates in any manner whatsoever.
<br />
<br /> SECTION 3. Any violation of this ordinance, or any portion thereof,
<br />shall be deemed a misdemeanor, and shall be punishable by a fine of not more than
<br />Five Hundred Dollars (~500.00)~ or by ~mprisonment in the County Jail Of the
<br />County of Orange for not more than six (6) months, or by both such fine and
<br />imprisonment.
<br />
<br /> SECTION 4~ All ordinances and parts of ordinances in conflict with
<br />this ordinance are hereby repealed.
<br />
<br /> SECTION 5. If any section, sub-section, sentence, clause or pb_~ase of
<br />this ordinance shall be found to be unconstitutional or invalid, the remainder of
<br />the ordinance shall not be invalidated thereby, but shall remain in full force
<br />and effect. The City Council hereby declares that it would have passed this
<br />ordinance and each section, sub-section, sentence, clause or phrase, irrespective
<br />of the fact that any one or more of the sections, sub-sections~ sentences~ clauses
<br />or phrases be declared unconstitutional or invalid.
<br />
<br /> SECTION 6. The City Clerk shall certify to the passage of this
<br />Ordinance, and cause the same to be published once in the "Santa Aha Daily Evening
<br />Register", a daily newspaper, printed and published and circulated in the City of
<br />
<br /> Santa Aha, Californ.ia,-and thereupon and thereafter said ordinance shall take
<br />effect.
<br />
<br /> ~EC~i0N ~ The existence and maintenace of conditions contrary to the
<br />provisions of this ordinance constitute a menace to the public peace of the
<br />citizens of Santa Aha. Therefore this ordinance is ~Eently recpired for the
<br />irmnediate preservation of the public peace.
<br />
<br /> The foregoing ordinance is approved this 8th dmF of 0ctober~ 193~.
