ORDINANCE NO. <br /> <br />AN ORDINANCE PROHIBITING THE USE OF WHITE CANES, <br />EXCEPT BYP~DESTRTANSWHOLLY OR PARTIALLY BLIND, <br />AND PROVIDING PRedileCTION AGAINST HIGHWAY ACCIDNNTS <br />TO SUCH PERSONS, AND PROVIDING PENALTIES FOR THE <br />VIOLATION <br /> <br /> The City Council of the City of Santa Aha o~dains aa follows: <br /> <br /> SECTION 1. It shali'be unlawful for any person, except persons wholly <br /> or partially blind, to carry er use on the public streets of the City of Santa Aha, <br /> any ca~es or walking-sticks which are white in color, or white with red end or <br /> bottom. Such canes or walking-sticks may be used on the streets and other public <br /> places of the City of Santa Aha by.persons wholly or partially blind, as a means <br /> of protecting them and for the purpose of identifyi~g them by drivers of vehicles, <br /> operators of motor-driven vehicles, and other pedestrians with whom they come in <br /> contac~ on such streets and public places. <br /> <br /> SECTION 2. Any driver of a vshicle, operator of a motor-driven vehicle, <br /> or pedest-~tam who is not wholly or partially blind who a~proaches or comes in <br /> contact with a person wholly or partially blind, carrying a cane or walking-stick, <br /> white in color, or white with red end, shall come immediately to a full stop and <br /> take such precautions before proceeding am may be necessary to avoid accident or <br /> injury to the person so carrying a white cane or walking-stick. <br /> <br /> SECTION 3. Any person other than a person wholly or partially blind, who <br />shall cax~y such a cane or walking-stick, such as is described in Section 1 hereof, <br />contrary to the provisic~s of this ordinance, or who shall fail to heed the <br />approach of a person so carrying such a white cane or walking-stick, or ~ne white <br />with red end, or who shall fail to come to a stop upon approaching or coming in <br />eo~mae~ with a person so carrying such a cane or walking-stick, or who shall <br />fail to take precautions against accident or injury to such a person after coming <br />to a stop as provided for herein, shall be guilty of a misdemeanor, and upon con- <br />vio~ion thereof shall be punished by a fine not to exceed Five Hundred Dollars <br />($800.00), or by~aprisonmen~ in the County Jail of the County of Orang~ for a <br />period not exceeding six (8) months, or by both such fine and imprisonment; and <br />each such person ~s principal, agent or otherwise, shall be deemed guilty of a <br />separate offense for each day during any portion of which the violation of, or <br />failure, neglect or refusal to comply with any of the provisions of this ordinm~ce <br />is cow--itted, continued or permitted by such ~rson. <br /> <br /> SECTION A. The City Clerk shall certify to the passage of this ordin~ c. <br />and cause the same to be published three (S) times in the "Santa Aha Daily Evening <br />Register", a daily mewSpaper, p~nted, published and generally circulated in the <br />City of Santa Aha, and the same shall take effect amd be in force thirty <br />after the first publication Shere~f. <br /> <br /> The foregoing em~ce ia aigaed amd approved by me this 2~rd day of <br /> April, 19~Ao <br /> <br />ATTEST: <br /> E.
