apply to the playing of music by a band or to the blowing of a bugle upon the public <br />street of said city for which a special permit in writing so t o do shall have flrs~ <br />been issued by the Chief of Police of said City, which permit shall specify the time <br />or times ~hen and the place or places ~;~here such ~usic may be so played or such bugle <br />may be blovn~. <br /> <br /> SECTION 3: That Ordinance No. 658 of the City of Santa Aha entitled "An <br />Ordinance Providingfor the Licensing of Business, Shows, Exhibitions and Games <br />Conducted or Carried on in the City of Santa Ana, F~xing the P~ate of License Therefore <br />and Providing for Collection Thereof", as amended, be and the same is hereby further <br />amended by the addition thereto of a new section at the end of Section 94 thereof, <br />which said new section shall be numbered Section 94-A and shall read as follows: <br /> <br /> "Section 94-A: For every person, firm or corooration conducting the <br />business of advertising by means of any vehicle containing amplifiers, phonograph, loud <br />speaker, microphone, broadcasting radio or a device for public address, and which is <br />used for announcing or advertising upon the public streets or public grotuuds in the <br />City of Santa Aha, a license fee of ~48.00 for each vehicle per annum or fraction <br />thereof payable annually in advance, provided, however, that for a fee of $12.00 for <br />each vehicle per annum or fraction thereof, payable annually in advance, a license will <br />be issued to any person, firm or corporation having a license ttuder any other section <br />of this ordinance to advertise only his ova business by means of any such vehicle <br />regularly registered and licensed by the State of California to such licensee. It is <br />not intended by this section to grant a license for the creating of a disturbance or <br />for.licensing any loud or unusual noise and the Chief of Police and all Police Officers <br />of the City shall have authority to prevent any disturbance!or loud or unusual noise <br />caused by the use of the above described appliances. <br /> <br /> SECTION 4: If any section, sub-section, sentence, clause or phrase of this <br />ordinance is for any reason held to be invalid or unconstitutional, such decision sha]l <br />not affect the validity of the remaining portions of the ordinance. The Council <br />of the City of Santa Ana hereby declares that it would have passed this ordinance, and <br /> <br />each section, sub-section, sentence, clause and phrase <br />fact that any one or more other sections, sub-sections, <br />be declared invalid or unconstitutional. <br /> <br />thereof, irrespective of the <br />sentences, clauses or phrases <br /> <br /> The City Clerk shall certify to the passage of this ordinance and shall <br />cause the same to be published in three consecutive issues of the Santa Aha Daily <br />Evening Register, a daily newspaper printed, oublished and circulated in the City of <br />Santa Aha, and hereby designated for that purpose, and 30 days thereafter shall take <br />effect and be in force. <br /> <br /> PASSED AND ADOPTED By the Council of the City of Santa Aha at its regular <br />meeting held on-the 17th da~ of June, 1935. <br /> <br />ATTEST: <br /> E, L.
