the Board of Forestry or by property owners, provided the same are merely placed near a
<br /> tree, shrub, or plant, for the purpose of protecting or training such trees, shrubs or
<br /> plants.
<br />
<br /> It shall be unlawful for any person to dump, pour or spill any oil, salt or
<br /> salt water or other deleterious matter upon any tree or tree space in any street, or
<br /> keep or maintain upon any sidewalk within ten (lC) feet of any such tree or tree space
<br /> on any street, any receptacle from which oil or salt water leaks or drips, or to pour
<br /> oil or salt water on to any parking or concrete gutter, so as to injure any tree on any
<br /> street.
<br />
<br /> It shall be unlawful for any person to pile building material, or other materis
<br /> about anymtree, plant or shrub in a street in any manner that will in any way injure
<br /> such tree, plant or shrub.
<br />
<br /> SECTION 1§: Any person, firm or corporation violating a~y of the provisions
<br />of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof,
<br />shall be punishable by a fine of not more than Five Hundred Dollars ($500.00), or by
<br />Lmprtsonment in the County Jail for a period of no~ more than six (6) months, or by both
<br />- such fine and imprisonment; and it shall be the duty of the Board of Forestry to cause
<br />
<br /> all such violations to be vigorously prosecuted.
<br />
<br /> If~ any section, subsection, sentence, clause or p~ase of this ordinance is
<br /> for any reason held to be unconstitutional, void or invalid, the validity of the r~m-in-
<br /> ing portions of this ordinance shall not be affected thereby, it being the intent of the
<br /> Council of the City of Santa Ana, in adopting this ordinance, that no portion thereof,
<br /> or provisions or regulations contained therein shall become inoperative or fail by
<br /> reason of any unconstitutionality or invalidity of any other portion, provision or
<br /> regulation.
<br />
<br /> SECTION 16: The Board of Forestry shall forthwith commence the preparation
<br />of a plan which shall designate by means of a complete map of the City streets, a
<br />uniform method of street tree planting, zoning certain streets for a certain specimen
<br />of tree or trees and shrub or shrubs, showing the distance apart of said trees or
<br />shrubs, and the place in which each tree or shrub is to be planted, and the Board of
<br />Forestry shall submit this plan to the City Council of the City of Santa Aha for
<br />modification and/or adoption by that body. If, and when the uniform plan of the Forestr
<br />Board in its original or modified form is adopted by the City Council, it shall become
<br />the tree planting plan for the streets of the City of Santa Aha, and shall be strictly
<br />adhered to in all future street plantlf~g, improvement projects, and in the removal and
<br />replacement of shrubs, trees and plants on streets of the City of Santa Ana; provided
<br />the City Council may at any time amend, alter, cancel, or repeal said plan, or may adopt
<br />an entire new plan as said Council m~y deem best. The uniform plan of tree planting
<br />may, but need not, be adopted in its entirety by the City Council at one time, but the
<br />City Council may adopt the uniform street tree planting plan for different portions of
<br />the City within a reasonable length of time after the completed plan for any particular
<br />portion of the City of Santa Aha has been submitted to the City Council. The Board of
<br />Forestry shall have copies of this plan m_~.de, and the same shall be kept on file in the
<br />office of the Board of Forestry and may be obtained by the public. Provided further,
<br />however, that the owners of property fronting on any street, alley or public place may
<br />petition the City Council*of the City of Santa Ana that such trees or shrubs shall be
