<br />AN ORDINANCE IN RELATION TO AND REGUL~&TING THE
<br />BUSINESS OF DEALING IN MOTOR VEHICLES AND PRO-
<br />VIDING PENALTIES FOR THE VI0~&TION HEREOF.
<br />
<br />THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS:
<br />
<br /> SECTION l: DEFINITION. For the purpose of this ordinance an automobil~
<br />dealer is defined to be any person, firm or, corporation engaged in, conducting,
<br />managing, or carrying on the business of buying, selling, or offering for sale~
<br />consigning to be sold, or otherwise dealing in motor vehicles (except bicycles),
<br />as the term "motor vehicle" is defined in the Vehicle Code of the State of
<br />California.
<br />
<br /> SECTION %: It shall be unlawful for any person to engage in the busines
<br />of an automobile dealer, as the same is defined in this ordinance without first
<br />having received a permit in v~iting so to do from the City Council of the City of
<br />Santa Aha. Any such permit shall be effective for a period of one year from its
<br />date.
<br />
<br /> Any person, firm or ;corporation desiring to obtain such a permit, shall
<br />make application therefor in writing to the City Council of the City of Santa Ana.
<br />Such apo!ication shall be filed with the City Clerk and the aoolicant shall at the
<br />time of-filing such application, pay the sum of Two Hundred (~00.00) Dollars to
<br />defray the expense of investigation and action upon such apolication, and such
<br />fee s~.!l be in addition to any license fee v~ich is now or may hereafter be
<br />required to be paid.

<br /> ~%at the City Clerk of the City of Santa Aha shall, upon receipt of an
<br />application and the fee hereinabove provided, cause a notice to be published in
<br />three consecutive issues of the newspaper then having the official contract f~r
<br />the publication of legal notices for the City of Santa Aha, giving notice that
<br />such an application has been made, and which said notice shall be sub~tially
<br />in words and figures, as follows, and shall contain the information indicated as
<br />follows, to-wit:

<br />"Notice of application for permit as
<br />automobile dealer.
<br />
<br /> "Notice is hereby given that has made application
<br />to the City Council of the City of Santa Ana for a permit to do business as an
<br />automobile dealer in this City. Any and all persons having any knowledge or
<br />information as'to why such a permit should not be granted to the applicant are
<br />hereby notifiSd to present such reasons in v~iting to the City Clerk on or before
<br />the day of , 19 Further oarticu]ars concerning said
<br />appl!-6~ay be .obtained from the a~olication_ on- file ~n the office of the City
<br />Clerk.

<br /> The date specified in said notice shall be not less than thirty (~0)
<br />nor more than sixty i(60) days after the date of the first publication of said
<br />notice.
<br />
<br /> It is provided, however, that any person, firm or .corporation having a
<br />license in this City at the present time as an autom~,bile dealer, may be issued a
<br />permit under this section immediately upon filing the application herein specifie~
<br />and paying the fee provided for a nenewal of any permit, and thereafter such
<br />permittee must cause said permit to be renewed in accordance with the provisions
<br />of this ordinance, provided however, t~t in the event that any such person
<br />holding a license at the present time shall fail for a period of thirty (~0) days
<br />after the effective date of thi~ ordinance to file with the City Clerk an app-
<br />lication as required by this ordinance, and to pay the fee for such renewal, then
<br />the right to such permit shall be deemed to be forfeited and thereafter an
<br />application must be made and fee paid to the City Clerk as in the case of an
<br />original application.

<br /> Such application shall be accompanied by an affidavit of the applicant
<br />which shall set forth the following information, to-wit: the name, age and
<br />residence address of the applicant, if a natural person, or if a corporation, its
<br />name, date and olace of Incorooratlon, address of its princioal o!ace of business,
<br />and the names o~ all its officers, together with their-respe~tiv$ addresses; or
<br />if a partnershio, association or unlncoroorated comoany, the names of the oartners
<br />comprising the association or company, together with their respective addresses,
<br />the address at which suck business is to be conducted, and a statement as to
<br />whether or not an application for a similar permit has been refused or cancelled
<br />by this or any other municipality in the State of California, and if so, a full
<br />statement of the reasons therefor.
<br />
<br /> Such ~opllcation shall further show that said applicant is to conduct
<br />his business at a fixed place where motor vehicles are and will be displayed for
<br />sale. All applications for a permit must be filed by the applicant, and if
<br />the applicant is a corporation or ps~tnership, the s~me mu~ be signed by a duly
<br />authorized officer on behalf of the corporation or any member of the partnership.
