Police shall~be deemed qualified to hold auy rank in the department, end shall <br />not be reduced below the rank of Sergeant without cause. ~ <br /> <br />SECTION 23: POWERS AND DUTIES OF THE CHIEF OF THE POLICE DEP;~TMENT <br /> <br /> The Chief of the Police Department shall, subject to the approval of <br />the City Council, have control, management, and direction of all members of the <br />Police Department, and all buildings, apparatus, and equipment of such Department, <br />as may be necessary in the lawful exercise of the functions of his office. <br />He shall have full power to detail any officer or member of the Police Department <br />to such public service as may be necessary. He shall reconnnend to the Civil <br />Service Board, members of the Police Department for demotion or dismissal, in <br />accordance with Section 13 hereof; mud also reco~end to the City Council, <br />applicants for appointment or p~omotion from the list of eligibles furnished by <br />the Civil Service Board in accordance with Section 7 hereof. <br /> <br />SECTION ~: VACANCIES IN THE POLICE DEPART~TENT <br /> <br /> Whenever a vacancy in the Police bepartment, above the grade of <br />Patr~olman and motorcycle officer, ~ccurs, the C~ief of the P~lice Department <br />may assign a member of the Department from the next lower rank to fill the <br />vacancy until such time as the absent member shall return to duty, or the <br />vacancy may be filled ' by appointment from the eligible list furnished by .the <br />Civil Service Board. The member so assi~ned shall, during his incumbency, <br />receive the salary attached to the grade or position thus temporarily filled. <br /> <br /> SECTION .25: ' <br /> <br /> No officer or member of the Fire Department or Police Department shall, <br />without the consent of th~Ir~Tespective Chief or the City Council, accept any <br />money, gratuity or c ompenaatfon for any service he may render in line of d~ty as <br />a member~ of that department. ~ <br /> <br /> SECTION 26: , ~ <br /> <br /> If any section, subsection,~ clause, or phrase of this ordinance is for <br />any reason held to be unconstitutional, such decision shall not affect the <br />validity of the remaining sections of this ordin~ce. <br /> <br />SECTION 27: <br /> <br /> Any provisions or clauses of the several ordinances of the City of <br />Santa Aha in conflict herewith are hereby expressly repealed. <br /> <br />SECTION 28: <br /> <br /> Whenever in this ordinance the masculine gender is used it ~hall be <br />deemed to include the feminine gender. <br /> <br />SECTION 29: FALSE MARKING, GRADING, ETC. PROHIBITED <br /> <br /> No jperson shall, by h~nuself or in cooperation with one or more persons, <br />cheat, dec~ive, or obstruct any person in respect of his right of examination <br />or registration according to the rules and regulations of this ordinance, for <br />falsely mark~'grade, estimate or report upon the examination of proper standing <br />of any person examined, registered or certified pursuant to the provisions of <br />this ordinance, or aid in so doing, or make any false representation concerning <br />the same, or cdncerning the person e~amined. <br /> <br />SECTION ~0: AMPiND~Q~NTS OF THIS ORDINANCE <br /> <br /> The City Council may from time to time, by ordinance, add additional <br />departments, appointive officers or employees of the City to the list originally <br />designated in this ordinance cre~ting a system of Civil Service. The City <br />~ouncil however, shall not have the authority or power to withdraw any department <br />or departments, appointive officers or employees from the operation of the system <br />created by this ordinance, unless and until the withdrawal thereof shall have <br />been submitted to the qualified electors of the City of Santa Ana at a special <br />or regular municipal election held in said City, and shall have been approved by <br />not less than a two-thirds vote of the electors voting on such proposition. <br /> <br />SECTION 51: VIOLATION OF ~tIS 0EDINANCE A ~,~ISD~EANOR <br /> <br /> Any person who shall violate any of the provisions of this ordinance <br />shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be <br />punished by a fine of not less than One Hundred ($100) Dollars or more than <br />Three Hundred ($~00) Dollars; or by i~prisonment in the County Jail for not <br />longer than three (~) months, or by both such fine and imprisonment. <br /> <br /> It appearing that a majority of the qualified electors voting at a <br />special ~lection held on the l~th day of November, 19~7, in the City of Santa Ana~ <br />voting upon the foregoing Ordinance voted in favor thereof, therefore, the <br />foregoing Ordinance be and the same is hereby adopted this 22nd day of November, <br />1957, at the meeting of the City Council of said City held on said date at which <br />time the vote on said election is canvassed and declared by the said City Council <br />and s aid Ordinance shall go into effect at the expiration of ten (10) days from . <br />the date hereof~ <br /> <br /> This ordinance declared ado~ ed by the City Council of the City 0f <br />Santa Ana at its regular adjourned meeting held on the 22nd day of .November, <br /> <br />1937, <br /> <br />Fred C.
