110 <br /> <br />ORDINANCE NO. 1060 <br /> <br /> AN ORDINANCE AMENDING ORDINANCE NO. 658 ENTITLED <br /> "AN ORDINANCE PROVIDING FOR THE LICENSING OF <br /> BUSINESS, SHOW, EXHIBITION AND GAMES CONDUCTED <br /> OR CARRIED ON IN TI~E CITY OF SANTA ANA, FIXING <br /> THE RATE OF LICENSE THEREFOR AND PROVIDING FOR <br /> COLLECTION THEREOF". <br /> <br /> THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That Section 42 of an Ordinance of the City of Santa Aha, <br />numbered No. 858, and entitled "AN ORDIN;2~CE PROVIDING FOR THE LICENSING OF <br />BUSINESS, SHOWS, EXHIBITION AND GA~ES CONDUCTED 0R CARRIED 0N IN TttE CITY OF <br />SANTA ANA, FIXING THE RATE OF LICENSE THEREFOR AND PHOVIDING FOR COLLECTION <br />THEREOF" be and the same is hereby amended so as to read as follows:- <br /> <br /> "Section 42: For every person, firm or corporation conducting, <br />managing or carrying on a closing out sale, fire sale, bankrupt sale or wreck <br />sale, $100.00 per month. <br /> <br /> For the purposes of this ordinance a "fire, bankrupt or wreck sale" <br /> is defined to be and include the s~le of goods, wares or merchandise salvaged <br /> from a fire, wreck or other calamity, or a sale of goods, wares or merchandise <br /> advertised as a fire or bankrupt or wreck s~le. <br /> <br /> For the p~rpose of this ordinance a "closing out sale" is defined <br /> <br />to be and include any sale of goods, W ares and merchandise which is~., or is <br />advertised to be, a sale for the purpose of disposing of the stock of merchandise <br />on hand or any major portion thereof in contemplation of discontinuing the <br />operation or maintenance of the store or place of business of the seller or the <br />removal thereof to another location, or any sale which is advertised or held out <br />as being a s ale under bankruptcy, mortgage insolvency or assignee's or <br />trustee's or creditor's sale. <br /> <br /> It is hereby declared to be unlawful for any person, firm or corp- <br />oration to conduct any sale mentioned in this section without having obtained a <br />permit so to do, issued by the City Clerk of the City of Santa Ans. Such permi~ <br />shall be issued by the City Clerk of the City of Santa Aha upon anplication and <br />the payment of the license herein required; provided that any person who has <br />had a license under this ordinance continuously for one year prior thereto may <br />obtain a permit without additional license fee, to conduct such sale in the <br />place of business covered by such license by filing with the City Clerk an <br />application therefor containing a true statement of the facts concerning such <br />closing out or removal, or fire, or bankrupt, or wreck sale, together with an <br />inventory of the merchandise on hand and proposed to be sold. Such permit <br />shall permit the sale of the merchandise then on hand in said store or place of <br />business and no other merchandise, and shall be valid for a period of thirty <br />(~0) days from day of its issuance and no license under this section shall be <br />required during s~id thirty (50) day period for the conduct of such sale. <br /> <br /> SECTION 2: The City Clerk shall certify to the passage of this <br />ordinance and shall cause the same to be published in three consecutive issues <br />of the ORANGE COUNTY REPORTER, a daily newspaper, printed, published and <br />circulated in the City of Santa Ana, and hereby designated for thatpurpose, <br />and thirty (50) days thereafter shall take effect and be in force. <br /> <br /> <br />
