any land, building, or premises be used, designed or intended to be used, for any <br />purpose other than a use listed in Sections 4, 5, 6, 7, 8, 9, l0 of this ordinance, <br />amendments hereto, as permitted in the district in which such land, building or <br />premises is located; <br /> <br />or <br /> <br /> 2. - no building shall be erected, nor shall any existing building be moved, <br />reconstructed, added to, enlarge~ or structurally altered to exceed in height the lib. it <br />established hy Sections 4, 5, 6, 7, 8, 9 and l0 of this ordinance or amendments hereto <br />for the district in which such building is located; <br /> <br /> 3. - no building shall be erected, nor shall any existing building be moved, <br />structurally altered, added to, enlarged, reconstructed or rebuilt, nor shall any open <br />spaces surrounding any building be encroached upon or reduced, in any manner except in <br />conformity with the building-site requirements and the area and yard regulations <br />established by Sections 4, 5, 6, 7, 8, 9 and lO of this ordinance or amendments thereto <br />for the district in which such building is located. <br /> <br /> 4. - no yard or other open space provided about any building for the purpose <br />of complying wi th the regulations of this ordinance, or amendments hereto, shall be <br />considered as providing a yard or open space for any other building or structure. <br /> <br /> 5. - while a non-conforming use exists on any lot no other use of more <br />restricted classification shall be permitted even though such other use would otherwise <br />be a conforming use. <br /> <br /> 6. - whenever the owner of any l~nd or building devotes the same to a use of a <br />more restricted classification than that permitted in the district where located, such <br />act shall constitute a waiver of any rights to claim that any uses of buildings or land <br />near or adjacent thereto constlt~te a nuisance in any manner different from that which <br />would be a nuisance if such use were of the least restricted classification permitted <br />in such district. <br /> <br />SECTION 4: R-1 RESIDENCE DISTRICT: (for convenience called single-family). <br /> <br />(a) Uses Permitted <br /> <br /> 1. One-family dwellings of a permanent character placed in permanent <br />locations, together with accessory buildings, including private garages to accommodate <br />not to exceed three cars. <br /> <br /> 2. Private greenhouses and horticultural collections for domestic non- <br />commercial use, public parks, fl~er and vegetable gardens, fruit trees, or any other <br />agricultural use. Temporary real estate offices devoted to sale of real estate in <br />the tract in which located only, and for a period of not to exceed one year, and private <br />recreation and playgrounds. <br /> <br /> 3. One (1) unlighted non-electric sign not exceeding six (6) square feet in <br />area pertaining only to the sale'~ lease or hire of only the particular building, propertl <br />or premises upon which displayed. No other advertising, signs, structures or devices <br />of any character shall be permitted in any R-1 (Single-family) Residence District. <br /> <br /> 4. Underground storage of not to exceed one thousand (9000) gallons of <br />petroleum fuel for heating buildings on the premises. <br /> <br /> 5. Fences and hedges not over six (6) feet in height but not exceeding four <br />(4) Feet in height, where such fence or hedge is nearer the front lot line than the <br />depth of required front yard. <br /> <br />(b) Building Height <br /> <br /> Two (2) stories and not to exceed thirty-five (35) feet except as provided in <br />Sections ll and 12. <br /> <br />(c) Building-site Area ReQuired <br /> <br /> Except as provided in Sections 11 and 12 the mininum building-site area for <br />each one-family dwelling shall be six thousand (6000) square feet, provided this limit <br />shall not apply to lots of less area if shown as such in the office of the County <br />Recorder before the effective date of this ordinance, or if under separate ownership <br />before such effective date. Not more than one (1) one-family dwelling shall be <br />permitted upon any one (1) lot. <br /> <br />(d) Front Yard Rev ired. <br /> <br /> Except as provided in Sections ll and 12, no building shall be erected closer t¢ <br />the front property line than the distauce shown upon the districting map, provided, when <br />no distance is shown, no building shall be erected closer than sixty (60) feet from the <br />center llne of the street upon which the building-site fronts. Distances shown on <br />Districting Maps for front yard depth are to be measured from center line of street. <br /> <br />(e) Side Yard Required. <br /> <br /> Except as provided in Sections ll and 12, each side yard shall be not less than <br />four (4) feet wide on lots fifty (50) feet wide or less, or five (5~ feet on lots wider <br />than fifty (50) feet. <br /> <br />(f) Rear Yard Required. <br /> <br /> Except ms provided in Sections 11 and 12, the depth of the rear yard shall be <br />not less than twenty (20) feet. <br /> <br /> <br />
