7/3 <br />~ ~ ~ RESOLUTION NO. <br /> <br /> 62~7 <br />ADMINISTRATOR AND THE PLANNING COMMISSION A~D <br />GRANTING VARIANCE APPLICATION NO. 1613 FILED BY <br />CRESENCIO AND TEREZA TALAVERA, SUBJECT TO CONDITIONS <br /> <br />OVERRULING THE ZONING <br /> <br /> WHEREAS, the Zoning Administrator, after public hearing on <br />notice, denied Variance Application No. 1613 filed by Cresencio and <br />Tereza Talavera; and <br /> <br /> WHEREAS, the Planning Commission affirmed the denial of said <br />Variance Application by the Zoning Administrator; and <br /> <br /> WHEREAS, Appeal Application No. 58 was duly filed by the <br />applicants requesting a hearing on said Variance Application No. <br />before the City Council; and <br /> <br />1613 <br /> <br /> WHEREAS, the City Council, after public hearing on notice, has <br />determined that the Zoning Administrator and the Planning Commission <br /> <br />should be overruled and that said Variance should be granted subject <br /> <br />to conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council hereby <br /> grants a variance on Variance Application NO. 1613 for that property <br /> known and numbered as 316-318 North Harper Street in the City of <br /> Santa Aha, County of Orange, State of California, and described as: <br /> <br /> Lots 15 and 16 of Tract 540, Laurel Square, as <br /> per map in Book 22, Page 44, Miscellaneous Maps, <br /> records of Orange County, <br /> <br />in an R-2 District to allow for the construction of a third dwelling <br />on the R-2 lot. Said Variance is granted subject to conditions as <br />follows: <br /> <br /> 1. That the proposed new detached single-family dwelling be <br />in accordance with all R-2 District regulations. <br /> <br /> 2. That the existing single-family dwelling on the Northerly <br />portion of the property be totally removed prior to the issuance of a <br />utilities release for the proposed new dwelling. This will result in <br />two dwellings allowed on this R-2 property in accordance with R-2 <br />regulations. <br /> <br />-1- <br /> <br /> <br />
