RESOLUTION NO. 62-89 AUTHORIZING CONDEMNATION <br />OF REAL PROPERTY ON THE SOUTH SIDE OF FIFTH STREET <br />BETWEEN BUSH AND SPURGEON STREETS AND DECLARING <br />THE PUBLIC NECESSITY THEREFOR <br /> <br /> WHEREAS, Section 1238.1 of the Code of Civil Procedure provides <br />that the right of eminent domain may be used by a city to acquire <br />property necessary for off-street parking of motor vehicles. <br /> <br />NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br /> <br />City of Santa Aha hereby finds and declares that the public use, <br /> <br />benefit, safety, economy and general welfare require that the City of <br /> <br />Santa Aha do have and take fee title for the purpose of establishing <br /> <br />off-street parking places to certain parcels of land in the City of <br /> <br />Santa Ana, County of Orange, State of California, described as: <br /> <br />PARCEL 1: The East 63.00 feet of Lots 8 and 9, Block 16, of <br />the Town of Santa Ana, as shown on a map recorded in Book 2, <br />Page 51 of Miscellaneous Records of Los Angeles County, <br />California. <br /> <br />PARCEL 2: The East 50.00 feet of Lot 5, Block 16, of the <br />Town of Santa Ana, as shown on a map recorded in Book 2, <br />Page 51 of Miscellaneous Records of Los Angeles County, <br />California. <br /> <br />Excepting therefrom the South 43.90 feet. <br /> <br /> BE IT FURTHER RESOLVED: <br /> <br /> 1. That said City Council hereby finds and declares that the <br />public ~aprovement herein being provided for is planned and located <br />in a manner which will be most compatible with the greatest public <br />good and the least private injury; <br /> <br /> 2. That the City Attorney is hereby ordered to bring an action <br />in the name of the City of Santa Ana in the Superior Court of the <br />State of California, in and for the County of Orange, to condemn the <br />property herein described; <br /> <br /> 3. That said action for condemnation herein ordered shall be <br />taken in accordance With the provisions of the Code of Civil Proced~e <br />and the Constitution of the State of California relating to eminent <br /> <br />domain. <br /> <br />-1- <br /> <br /> <br />
