<br /> AN ORDINANCE OF THE CITY OF SANTA ANA
<br /> REQUIRING PROTECTION AGAINST INCENDIARISM
<br /> AND SABOTAGE BY OWNERS AND OCCUPANTS OF
<br /> VULNERABLE PREMISES AND FIXING PENALTY.
<br />
<br /> WHEREAS, a state of war exists between the United States of America
<br />
<br /> and Japan;
<br />
<br /> NOW, THEREFORE, the City Council of the City of Santa Ana does hereby
<br /> declare by a four-fifths vote of all its members that a case of urgency exists
<br /> and that such urgency affects the health and safety of the public and requires
<br /> the immediate adoption of this ordinance; and this ordinance is adopted as
<br /> an urgency measure for the protection of the public health and safety;
<br />
<br /> NOW, THEREFORE, the Council of the City of Santa Ana do ordain as follows:
<br /> SECTION 1: It shall b e unlawful for any person, firm, corporation or
<br /> association owning, controlling, leasing, acting as agent for, conducting,
<br /> operating or managing anyplace of business, building, structure, or premises,
<br /> while having the ability so to do, to fail, neglect, or refuse to furnish,
<br /> maintain, install, or supply any equipment, material, supplies, personnel or
<br /> guards or patrols necessary or appropriate for the protection of such place of
<br /> business, building, structure or premises against fire or other destruction
<br /> or damage.
<br />
<br /> The Chief of Police of the City of Santa Ana and the Fire Chief of the
<br /> City of Santa Ana and their assistant chiefs are hereby authorized and em-
<br /> powered to determine what equipment, materials, supplies, personnel, guards
<br /> or patrols are necessary for such protection of such premises, and the decision
<br /> of such Chief of Police or Fire Chief or their assistants shall be prima facie
<br /> evidence of the necessity therefor.
<br />
<br /> SECTION 2: It shall be unlawful for any person, firm, corporation or
<br /> association, controlling, owning, leasing, acting as agent for conducting,
<br /> operating or managing any place of business, building, structure or premises,
<br /> to fail, neglect or refuse, when having the ability so to do, to furnish,
<br /> install, maintain or operate any lights or to discontinue the use of any lights
<br /> visible.from outside of said structure, building or premises when required so
<br /> to do by the said Chief of Police or said Fire Chief or their assistants, and
<br />
<br />~ the decision of such Chief of Police, Fire Chief or their assistants shall be
<br /> prima facie evidence of the necessity for complying with such order or require-
<br /> ment.
<br />
<br /> SECTION 3: In the event of the declaration of an emergency by this
<br />
<br /> City Council pursuant to the provisions of Ordinance No. 1099 of the City of
<br /> Santa Ana, entitled "AN ORDINANCE OF THE CITY OF SANTA ANA CREATING A MAJOR
<br /> DISASTER EMERGENCY PLAN FOR THE SAFEGUARDING OF LIFE, HEALTH AND PROPERTY",
<br /> then and in that event the powers herein granted to the Chief of Police and
<br /> Fire Chief and their assistants shall be extended to include any and all persons
<br /> Working upon the emergency relief work pursuant to the terms of said ordinance.
<br />
<br /> SECTION 4: Any person who fails or refuses to conform to the orders
<br />
<br /> of the Chief of Police or Fire Chief or their Assistants or of any person law-
<br /> fully wearing any lawful badge or insignia under a State of Emergency shall be
<br /> guilty of a misdemeanor, and upon conviction shall be punished by a fine of
<br /> not more than Three Hundred ($300.00) Dollars or by imprisonment in the County
<br /> Jail for a period not to .exceed ninety (90) days, or by both such fine and
