ORDINANCE NO. 1178 AN ORDINANCE OF THE CITY OF SANTA ANA PROHIBITING CERTAIN EXCAVATIONS BENEATH THE CITY STREETS THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS: Section l: I$ shall be unlawful for any person, firm or cor- poration ~o construct or excavate, or cause or permi~ the construction or excavation of any basement, elevator, elevator shaft, tunnel or o~her ex- cavation, under any public street in the City of Santa Aha, beyond a poin~ one-half the distance from the proper~y line abutting such street, to the curb of such street. Section ~: The provisions of ~his ordinance do not apply to temporary excavations in or under the puOlic streets permitted by other ordinances of the city, nor do they apply as to public utilities exca- vatlng in or under the city streets, under ~he valid exercise of a city franchise. Section 3: Any person, firm or corporation, as p~incipal, agent, contractor or employee, whether ac~Ing for himself or itself or for another person, firm or corporation, who or which shall violate any provision of this ordinance, shall be guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine not exceeding $500.00, or by imprisonment in the County Jail not exceeding six months, or by both such fine and imprisonment. Section 4: The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published in three consecutive issues of the Santa Ana Register, a newspaper prin~ed, published and circulated in the City of Santa Aha, and hereOy designated for ~ha~ purpose. This Ordinance shall ~ake effect ~hirty (30) days from and after its adoption. PASSED AND ADOPTED by the Ci~y Council of the City of Santa aha at its regular meeting held on the 19th day of August, 1948.
