RESOLUTION NO. 63-15 AUTHORIZING CONDE~NATION <br />OF REAL PROPERTY FOR THE EASTERLY EXTENSION <br />OF ALTON STREET ACROSS HALLADAY STREET <br /> <br /> WHEREAS, Alton Street as it now exists dead-ends West of <br />Halladay Street, is inadequate to satisfy the present demand for <br />East-West traffic in this industrial area of the City, and is not <br />adequate to provide for traffic circulation in the area. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Aha hereby finds and determines that public <br />interest and necessity require that Alton Street be extended to <br />and across Halladay Street, and further require that said City do <br />have and acquire an easement for street purposes over, through and <br />across certain land in the City of Santa Aha, County of Orange, <br />State of California, described as: <br /> <br />A strip of land 30 feet wide, bounded Southerly by the <br />center line of Alton Street, said center line being on <br />the South line of the Northeast quarter of the Southwest <br />quarter of Section 30 in Township 5 South, Range 9 West, <br />San Bernardino Base and Meridian, as said South line is <br />shown on a map of the Seccombe Addition to Dyer, recorded <br />in Book 8, Page 17, Miscellaneous Maps, Records of Orange <br />County, bounded Northerly by a line parallel with and <br />30.00 feet Northerly, measured at right angles from said <br />center line of Alton Street, bounded Easterly by the <br />Southerly extension of the East line of Lot 26 in Block "B" <br />of said Seccombe Addition, bounded Westerly by the West <br />line of Lot 26 in Block "A" of said Seccombe Addition. <br /> <br />EXCEPTING THEREFROM that portion previously dedicated <br />for Harbor Road now known as Halladay Street. <br /> <br />BE IT FURTHER RESOLVED: <br /> <br /> 1. That the City Attorney is hereby ordered to bring an <br />action in the name of the City to condemn said property necessary <br />to be taken and to do all things necessary to prosecute said action <br />to final determination; <br /> <br /> 2. That p~blic interest, necessity and convenience require <br />and it is hereby ordered that said City take immediate possession <br />and use of the property herein ordered to be acquired upon compliance <br />with the requirements of law applicable thereto as a right of way <br />for public use; <br /> <br /> 3. That said public improvement is planned and located in <br />a manner which will be most compatible with the greatest public <br />good and the least private injury; <br /> <br /> 4. That the City of Santa Ana, a municipal corporation, is <br />authorized and empowered to provide for the opening, extension, <br />widening, construction and maintenance of public streets and <br />highways within the City; <br /> <br /> 5. That said action in condemnation shall be taken in <br />accordance with the provisions of the Code of Civil Procedure and <br />the Constitution of the State of California relating to eminent <br />domain. <br /> <br />CLERK OF THE COUNCIL <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 21st day of January, 1963. <br /> <br />ATTEST: /~ <br /> <br /> <br />
