RESOLUTION NO. 63-740F THE CITY COUNCIL OF <br />THE CITY OF SAi~TA ANA, REQUESTING CONSTRUCTION <br />OF A WATER SERVICE CONNECTION BY THE METROPOLITAN <br />WATER DISTRICT OF SOUTHERN CALIFORNIA, UPON THE <br />TERMB AND CONDITIONS PRESCRIBED IN RESOLUTION 6296 <br />OF ITS BOARD OF DIRECTORS <br /> <br /> W}{EREAS, a request has been made on behalf of the City of Santa <br />hereinafter designated CITY, that a service connection be constructed upon the <br />Orange County feeder of the Metropolitan Water District of Southern California, <br />hereinafter designated METROPOLITAN~ at the intersection of Tustin Avenue and <br />Santa Clara Avenue, for delivery of water by METROPOLITAN to CITY for use <br />within CITY; and <br /> <br /> W/~EREAS~ the Board of Directors of METROPOLITAN at its meeting <br />on April 9~ 1963~ adopted its Resolution 6296 authorizing the construction <br />of said service connection upon the terms and conditions fixed in said <br />Resolution, a certified copy of which Resolution has been received by CITY; and <br /> <br /> WHEEEAS~ it is proper, under the policy of METROPOLITAN~ that such <br />service connection be constructed at the expense of CITY and without cost to <br />METROPOLITAN upon the terms and conditions set out in METROPOLITAN's said <br />Resolution; <br /> <br />NOW, THEREFORE, BE IT RESOLVED THAT: <br /> <br /> 1. T~e certified copy of METROPOLITAN's said Resolution referred <br />to in the recitals hereof is ordered filed in the Office of the Clerk of the <br />Council· attached to this Resolution No. 63-?2 <br /> <br /> 2. METROPOLITAN is requested to construct the service connection <br />referred to in the recitals of this Resolution and such construction is <br />authorized on behalf of CITY in the manner and upon the terms and conditions <br />prescribed in METROPOLITAN's Resolution. <br /> <br /> 3. CITY agrees to pay~ or reimblarse to METROPOLITAN~ all costs of <br />providing, constructing~ and installing said service connection in accordance <br />with the terms and conditions of METROPOLITAN's Resolution which is hereby <br />incorporated by reference. <br /> <br /> 4. The Director of Public Works of CITY is hereby authorized to <br />approve the plans and specifications for said service connection and to <br />request co~encement and/or suspension of service through said connection. <br /> <br /> 5. CITY agrees to pay METROPOLITAN for all water delivered through <br />said connection at the rate from time to time fixed by the Board of Directors <br />of METROPOLITAN. <br /> <br /> 6. The Mayor and Clerk of the Council of said CIT~ be and they hereby <br />are authorized to execute, on behalf of CITY, any agreement or agreements <br />necessary or required by METROPOLITAN to be entered into between METROPOLITAN <br />and CITY in order to provide for the construction of said service connection <br />in the manner and subject to the terms and conditions setforth in METROPOLITAN's <br />said Resolution~ and to affix the corporate seal of CITY to any such agreement <br />or agreements; provided, however· that the signatures of the Mayor and Clerk <br />of the Council of said CITY, together with the corporate seal of CITY~ affixed <br />to a certified copy of this resolution~ shall, if acceptable to METROPOLITAN, <br />be~ and be deemed to be~ an agreement on the part of CITY for complying with <br />and carrying out all of the terms and conditions set forth herein and in <br />METROPOLITAN's said Resolution. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa Aua at <br />its regular meeting held on the 6th day of May · 1963. <br /> <br />ATTEST: <br /> <br /> CLERK OF THE COUNCIL <br /> <br /> <br />
