RESOLUTION NO. 63-78 INITIATING PROCEEDINGS <br />FOR ANNEXATION OF TERRITORY TO THE CITY OF <br />SANTA ANA, DESIGNATING AN APPROPRIATE NAME <br />FOR SAID TERRITORY OF "FIFTH STREET AND SANTA <br />ANA RIVER - S. E. ANNEX" AND GIVING NOTICE <br />OF PROTEST HEARING THEREON <br /> <br /> WHEREAS, at the request of property owners in the territory <br />herein described, a description and map of said territory were pre- <br />sented to the Santa Ana Planning Commission, which approved annex- <br />ation of said territory, and to the Orange County Boundary C~lu~Lission, <br />which caused a report to be prepared finding that the boundaries of <br />said proposed annexation met the approval of the Orange County <br />Surveyor's office in respect to Government Code Section 35002. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />city of Santa Ana hereby initiates proceedings for annexation of said <br />territory, herein described, to the City ~f Santa Ana for the <br />following reasons: <br /> <br />That the said territory can best be served by the City <br />of Santa An& with municipal services of the highest <br />quality anywhere obtainable at a cost for such services <br />which is lower than can be obtained anywhere else in <br />the County of Orange. <br /> <br />That it is to the mutual advantage of the City and the <br />land owners that said territory become a part of said <br />City. <br /> <br /> BE IT FURTHER RESOLVED: That the City Council hereby declares <br />its intention to annex all of the territory hereinbelow described <br />under the provisions of the Annexation of Uninhabited Territory Act <br />of 1939; hereby finds and declares that said territory is uninhabited <br />within the meaning of Government Code Section 35303 on the date of <br />the adoption of this Resolution; that said territory is contiguous <br />to the City of Santa Ana, lies in the County of Orange, State of <br />California, and is described as: <br /> <br />Beginning at a point in the Westerly line of the 400 foot <br />wide right of way for the Channel of the Santa Ana River, <br />said point being on a line parallel with and 30.00 feet <br />North, measured at right angles, from the center line of <br />Fifth Street as said Fifth Street was cenveyed to the <br />County of Orange by deed recorded in Book 232, Page 327, <br />Deeds, Records of Orange County, California, said point <br />being an angle point in the boundary of the City of Santa <br />Ana, as established by Ordinance NO. N.S. 367; and running <br />thence from said point East 860 feet, more or less, along <br />said City Boundary and along said parallel line to an <br />angle point in said City Boundary, as establishedby <br />Ordinance No. N.S. 367; thence, continuing along said City <br />Boundary South 23° 23' 10" West 769.33 feet to an angle <br />point in said City Boundary, as establishedby Ordinance <br />NO. N.S. 213 and N.S. 66, and to a point in that certain <br />boundary line established by agreement between J. H. Stewart, <br />Et u~., and L. L. Merchant, Et ux., recorded February 28, <br />1925 in Book 565, Page 159, Deeds, Records of said Orange <br />County; thence, West 410 feet, more Or iess, along said <br />certain boundary line and along said City Boundary to a <br />point on the Easterly right of way line of said Santa Ana <br />River Channel, and to an angle point in said City Boundary <br />as established by Ordinance No. N.S. 66, said line being <br />the arc of a curve concave Southeasterly and having a <br /> <br />-1- <br /> <br /> <br />
