RESOLUTION 63-95 OVERRULING ~HE PLANNING <br />COMMISSION AND GRANTING A VARIANCE ON <br />VARIANCE APPLICATION NO. 1759 FILED BY <br />THOMAS J. BOWMAN, SUBJECT TO CONDITIONS <br /> <br /> WHERE~S, after public hearing on notice, the Planning <br />Commission denied Variance Application No. 1759, filed by THOMAS' <br />J. BOWMAN to construct a new wrecking yard office and sales building <br />in the C-2 and R-2 Districts and located at 3117 West Fifth Street; <br />and <br /> <br /> WHEREAS, Appeal Application No. 83 was duly filed by said <br />applicant requesting a hearing on said Variance Application before <br />the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, <br />has determined that the Planning Commission should be overruled and <br />that said Variance should be granted, subject to conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council <br />hereby grants a variance on Variance Application No. 1759 to permit <br />the property located at 3117 West Fifth Street, in the City of <br />Santa Ana, County of Orange, State of California, described as: <br /> <br />Lot 16 of Tract No. 477, and a portion of the Northeast <br />quarter of the Southwest quarter of Section 10, Township <br />5 South, Range 10 West, San Bernardino Base and Meridian, <br /> <br />in the C-2 and R-2 Districts, to be used for the construction of a <br />new wrecking yard office and sales building. Said Variance is <br />granted subject to the following conditions~ <br /> <br />1. That a minimum of tan (10) 9' x 20' accessible and useable <br /> off-street parking stalls be provided; <br /> <br />2. That all parking stalls, driveways and maneuvering areas be <br />on hard surface asphalt or concrete and be marked; <br /> <br />That all lighting used in conjunction with the wrecking <br /> operation and retail sales facilities be reflected away <br /> from any nearby residences; <br /> <br />That an eight-foot solid block wall be constructed around the <br /> entire wrecking yard facility except at the front where the <br /> building forms a part of the wall; <br /> <br />5. That development otherwise conform to all provisions of the <br /> M-2 District. <br /> <br />THE FOLLOWING CONDITION IS TO BE COMPLIED WITH PRIOR TO THE ISSUANCE <br />OF A BUILDING PERMIT: <br /> <br />6. That the owner pay a drainage assessment fee of $415.00 per <br /> acre on the Northerly 380 feet of the parcel; <br /> <br />THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE <br />ISSUANCE OF UTILITIES R~LEASE: <br /> <br />7. That the owner provide sanitary sewer and storm drain facilities <br /> to meet with the approval of the Department of Public Works; <br /> <br />8. That sidewalk be placed on all frontage on Fifth Street where <br /> sidewalk does not exist. <br /> PASSED ~ ADOPTED by the City Council of the City of Santa <br />Aha at its regular meeting held on the 17J~ day of Ju~e, 1~63. <br /> <br />CLERK OF THE COUNCIL <br /> <br /> <br />
