RESOLUTION 63-96 MODIFYING CONDITIONS NO. 13 AND <br />14 TO A VARIANCE GRANTED BY THE PLANNING COMMISSION <br />ON APPLICATION NO. 1760 FILED BY SY DEVELOPMENT CO. <br />AND McFADDEN HOMES <br /> <br /> WHEREAS, after hearing on notice, the Planning Cc~mission <br />granted a variance on Variance Application No. 1760, filed by <br />SY DEVELOPMENT CO. and McFADDEN HOMES, to permit the construction <br />of a 568-unit one and two story apartment complex on C-4 property <br />between Fairview and Sullivan Streets, North of McFadden Avenue; and <br /> <br /> WHEREAS, Appeal Application No. 84 was duly filed by DALE H. <br />HEINLY, Attorney, on behalf of said applicants, requesting a hearing <br />before the City Council to reconsider Conditions No. 13 and 14 as <br />set forth by the Planning Commission; and <br /> <br /> WHEREAS, after hearing, the City Council has determined that <br />said Conditions No. 13 and 14 should be modified as hereinbelow <br />set out. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That Conditions No. 13 and <br />14 as set forth on Page 3 of the Findings of Facts on said Variance <br />Application should read as follows: <br /> <br />13. That owner place curb, gutter and sidewalk and pave <br />to the Center line of Sullivan Street, the new curb and <br />gutter to be placed 20 feet West of the center line of <br />Sullivan Street, and that said street improvements be <br />constructed all at one time in conjunction with City <br />improvements of said street area, but that said work need <br />not be done until owner does development work on the East <br />half of said property. <br />14. That the owner place a 5-foot sidewalk in accordance <br />with City requirements along the property line on Fairview <br />Street, the same to be installed in two stages; the first <br />half prior to the issuance of a building permit for the <br />one-quarter of the property behind said sidewalk, and the <br />second half prior to the issuance of a building permit <br />for the development of the one-quarter of the property <br />behind said sidewalk. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Aha at its regular meeting held on the 3rd day of June,.1963./ <br /> <br /> //VICE-MAYOR <br />CLERK OF THE COUNCIL <br /> <br />STATE OF CALIFORNIA) <br />COUNTY OF ORANGE ) SS <br />CITY OF SANTA ANA ) <br /> <br /> I, DORIS M.
