Being on call does not constitute hours worked since employees are off-duty <br /> and permitted to engage in personal pursuits. <br /> Employees are required to respond to a phone call as quickly as possible. Upon <br /> responding, the employee will be instructed as to whether they are required to <br /> return to work (it is possible that the issue could be resolved by talking to the <br /> employee on the phone or using a computer to resolve the issue) and if so, will <br /> be informed of the location to which they must respond. Response time will <br /> generally be the employee's normal commute time and any additional minimal <br /> time necessary to get ready to return to work. <br /> B. Employees who are ordered back to work while off-duty because of an emergency <br /> or other unforeseen event will be paid for travel time at the overtime rate from the <br /> time they leave their home until they return home, or until their regularly scheduled <br /> shift begins. Only that period of time devoted to work will be compensated. <br /> C. Employees who are called at home and offered voluntary overtime work, and elect <br /> to accept the offer, will not be compensated for travel time in any manner. <br /> Similarly, employees who sign up for voluntary overtime, or who have advance <br /> notice that they will have to work during their off-duty time on an overtime basis, <br /> will not be compensated for travel time. <br /> 8.11 Accrued Compensatory Time Off Paid Upon Promotions or Upon Separation. Upon an <br /> employee's appointment to a position in which overtime may not be earned or upon an <br /> employee's separation from employment with the City they shall be compensated for <br /> accrued compensatory time on the next payday. <br /> 8.12 Court Appearance. Compensation for court appearance shall be as follows: <br /> A. For each required court appearance made by an employee during their off-duty time <br /> regarding City business, employees shall be paid overtime for the period of time <br /> from their arrival at court until they are released from court or the court session <br /> closes for that day. However, in no case, shall an employee receive less than two <br /> (2) hours overtime for a court appearance. If court appearances are made both in <br /> the morning and afternoon of a particular day, the employee shall receive a <br /> minimum of two (2) hours overtime for each session attended. Employees who <br /> appear in court in the morning and are required to stay until through the court's <br /> meal break into the afternoon session will be considered to be in paid status during <br /> the court's meal break. <br /> The employee must provide a copy of the subpoena requiring their attendance to <br /> initiate payroll procedures. <br /> B. A subpoenaed employee scheduled to appear in court on City business during off- <br /> duty time may be placed on on-call status by the Police Chief or their authorized <br /> representative if the employee can respond to the court, if called, within sixty (60) <br /> minutes of the employee's notification. In the event such off-duty employee is on <br /> on-call status during any court session and is not required to appear in court, such <br /> 30 <br />
