ARTICLE III <br /> 3.0 ATTENDANCE, WORK PERIOD, WORK SCHEDULE& WORKDAY <br /> 3.1 Attendance. Employees covered by this MOU shall be in attendance at their work location <br /> during hours prescribed by the Police Chief or their designee(s) and shall not absent <br /> themselves during prescribed hours without approval of the Police Chief or their <br /> designee(s). <br /> 3.2 Definitions. <br /> A. Standard Work Period. The Standard Work Period shall consist of a consecutive <br /> seven (7) day, one hundred sixty-eight(168) hour period. <br /> B. Alternative Work Period-207(k)Exempt Employees. The Alternative Work Period <br /> shall apply to all members of the Association who are peace officers, correctional <br /> officers or correctional supervisors who are subject to the partial overtime <br /> exemption provided by the Fair Labor Standards Act (FLSA) pursuant to Section <br /> 207(k). The 207(k)employees' Work Period shall consist of a consecutive twenty- <br /> eight (28) day, six hundred seventy-two (672) hour time period. In conformance <br /> with the FLSA, members who are peace officers, correctional officers, or <br /> correctional supervisors shall not be eligible for FLSA overtime, as defined under <br /> the FLSA for employees assigned to the Alternate Work Period until they have <br /> worked in excess of one hundred seventy-one (171) hours in the Alternate Work <br /> Period. Nothing in this section shall prevent a peace officer, correctional officer or <br /> correctional supervisor from earning overtime and being compensated for overtime <br /> based on the overtime provisions as stated in Article VIII of this MOU. All <br /> overtime shall be paid at one and one-half(1 1/2) times the regular rate of pay. <br /> Regular Rate of Pay: Shall mean the base rate of pay and any Assignment and Other <br /> Special Pay Additives, Career Development Program Pay, Call-Back-Duty and <br /> Court Appearance pay as listed in Article V, VI and VIII. <br /> C. Work Hours. Work hours are the regularly scheduled hours of work as determined <br /> by the Police Chief or their designee. A"day" is defined as any consecutive twenty- <br /> four(24) hour period. <br /> D. Work Schedules. The Police Chief has established the following work schedules. <br /> These schedules may be changed by the Police Chief based on operational need. <br /> The City will negotiate over any impacts of schedule changes. <br /> 1. Standard Work Period Schedules. <br /> a. 5/40 Work Schedule. Employees shall work five (5) eight(8) hour <br /> workdays per seven (7) consecutive days, one hundred sixty-eight <br /> (168) hour Standard Work Period. Each workday shall consist of <br /> eight(8)hours of work and a thirty(30)minute unpaid meal period. <br /> 5/40 work schedules for employees may be an option if approved by <br /> their supervisor/manager. <br /> 3 <br />
