RESOLUTION 63-104 AUTHORIZING CONDEMNATION OF REAL PROPERTY FOR WATER PRESSURE REGULATING AND FLOW CONTROL STATION NEAR THE INTERSECTION OF WARNER AND NEWPORT WHEREAS, the City of Santa Ana is providing for connection to the East Orange County Feeder No. 2 and will have to provide a water pressure regulating and flow control station near the inter- section of Warner and Newport Avenues to integrate said connection into the City water system. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby finds and determines that public interest and necessity require that said City do have, take and acquire in fee simple title for the location of a necessary element of the Santa Ana water system that certain land in'the City of Santa Ana, County of Orange, State of California, described as: That portion of the Southeast one-quarter of the Southwest one-quarter of Section 20, Township 5 South, Range 9 West, San Bernardino Base and Meridian, described as follows: Commencing at the center line intersection of Newport Avenue and Warner Avenue, said center line of Warner Avenue being the South line of said Section 20; running thence North 40° 39' 12" East 71.79 feet alongosaid center line of Newport Avenue; thence North 49 20' 48" West 136.00 feet to the Southerly extension of a radial to curve concave Northwesterly having a radius of 530.00 feet; thence, North 15° 19' 28" West 95.54 feet along said Southerly extension to said curve; thence Easterly along the arc of a curve through a central angle of 5° 53' 20" an arc distance of 54.47 feet, to the true point of beginning; thence continuing Easterly along said curve through a central angle of 5~ 23' 22" an arc distance of 49.85 feet to a point on a nontangent line; thence South 49~ 20' 48" East 29.71 feet; thence South 40° 39' 12" West 45.00 feet; thence North 49~ 20' 48" West 51.13 feet to the true point of beginning. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered to bring an action in the name of the City to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; 2. That the City of Santa Ana, a municipal corporation, is authorized and empowered to provide for the service of potable water to the citizens and lands within the City; to maintain and extend its water system, necessary pipes, valves and other structures for the said purpose and to acquire rights of way ~r fee title as the same may be necessary for said purposes; 3. That said public improvement is planned and located in a manner which will be most c~patible with the greatest public good and the least private injury; 4. That said action in condemnation shall be taken in accordance with the provisions of the code of Civil Procedure and the Constitution of the State of California relating to eminent domain.
