RESOLUTION 63-114 AUTHORIZING CONDEMNATION OF <br />AN EASEMENT FOR WATER MAIN AND UNDERGROUND WATER <br />VAULT PURPOSES NEAR THE INTERSECTION OF REDHILL <br />AND WARNER AVENUES AND NEAR THE INTERSECTION OF <br />TUSTIN AND SANTA CLARA AVENUES <br /> <br /> WHEREAS, the City of Santa Aha is providing for connections <br />to the East Orange County Feeder No. 2 to provide water for the <br />use of the citizens of Santa Aha and must provide connecting water <br />mains and underground water vault structures to connect said Feeder <br />with the City water system. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana hereby finds and determines that public <br />interest and necessity require that said City do have, take and <br />acquire easements for the location of necessary elements of the <br />Santa Ana water system referred to above in, through and over that <br />certain land in the City of Santa Ana, County of Orange, State of <br />California, described as: <br /> <br />An easement for water main and underground water vault <br />purposes in, through and over that portion of Lot 95, <br />Block 10 of the Irvine Subdivision as shown on a map <br />thereof recorded in Book 1, Page 88, Miscellaneous Record <br />Maps, Records of Orange CoUnty, California described as <br />follows: <br /> <br />PARCEL 1: The Northwesterly 20.00 feet of the Southeasterly <br />50.00 feet of the Southwesterly 85.00 feet. <br /> <br />PARCEL 2: The Northeasterly 20.00 feet of the Southwesterly <br />50.00 feet of the Southeasterly 150.00 feet EXCEPTING <br />THEREFROM that portion included within Parcel 1. <br /> <br />PARCEL 3: Beginning at a point On the Northwesterly line of <br />Parcel 1, 10 feet Southwesterly from the most Northerly <br />corner thereof and running thence Southwesterly along said <br />Northwesterly line 25.00 feet; thence Northwesterly along <br />the Northeasterly line of Parcel 2, 25.00 feet, thence in a <br />straight line to the point of beginning. <br /> <br />An easement for water main and underground water vault <br />structures in, through and over that portion of the West <br />One-half (W.½) of the South One-half (S.½) of Lot 5 in <br />Block B of the A. B. Chapman Tract as surveyed by Frank <br />Lecouvreur in December, 1870, described as follows: <br /> <br />PARCEL 4: The East 15.00 feet of the West 65.00 feet of <br />the South 190.00 feet. <br /> <br />PARCEL 5: The East 10 feet of the West 50.00 feet of the <br />South 105.00 feet. <br /> <br />BE IT FURTHER RESOLVED: <br /> <br /> 1. That the City Attorney is hereby ordered to bring an <br />action in the name of the City to condemn said property necessary <br />to be taken and to do all things necessary to prosecute said action <br />to final determination; <br /> <br /> 2. That the City of Santa Ana, a municipal corporation, is <br />authorized and empowered to provide for the service of potable <br />water to the citizens and lands within the City; to maintain and <br />extend its water system, necessary pipes, valves and other structures <br />for the said purpose and to acquire rights of way or fee title as <br />the same may be necessary for said purposes; <br /> <br /> <br />
