RESOLUTION 63-144 OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA RECOMMENDING LEGISLATION <br />WHICH WOULD PREVENT STATE AGENCIES FROM PREEMPTING <br />THE FIELD OF LOCAL BUILDING REGULATIONS IF THE <br />LOCAL JURISDICTION HAS ADOPTED THE NATIONALLY <br />RECOGNIZED CODES SPECIFIED IN SECTION 17922 OF <br />THw- CALIFORNIA HEALTH AND SAFETY CODE <br /> <br /> WHEREAS, the City Council of the City of Santa Ana is con- <br />cerned over recent State legislation which could result in the <br />State of California preempting the field of building regulations <br />on a local level; and <br /> <br /> WHEREAS, the City is a strong advocate of the "Home Rule" <br />concept; and <br /> <br /> WHEREAS, this City and other municipalities throughout the <br />State use the nationally recognized codes and keep pace with modern <br />practices and technologies by adopting amendments where necessary <br />to meet local requirements; and <br /> <br /> WHEREAS, this City is concerned over the fact that in some <br />cases local governing bodies are not permitted to designate which <br />agency or division within its government shall be the enforcement <br />agency of any given State agency regulation which is delegated to <br />a local jurisdiction for enforcement. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Aha urges the introduction and adoption of amend- <br />ments to the State Health and Safety Code for the purpose of: <br /> <br />(1) <br /> <br />retaining for local governing bodies the option of <br />adopting and enforcing building regulations in lieu <br />of similar State regulations provided minimum standards <br />are maintained equivalent to those prescribed in the <br />State regulations; and providing that any local agency <br />which adopts the nationally recognized codes specified <br />in Section 17922 of the California Health and Safety <br />Code would automatically be deemed to have regulations <br />equivalent to the regulations promulgated by the <br />State Division of Housing; <br /> <br />providing that local governing bodies should be <br />permitted to designate the local enforcement agency <br />whenever a State agency regulation is delegated to <br />a local jurisdiction for enforcement. <br /> <br /> BE IT FURTHER RESOLVED: That the Clerk of the Council of <br />the City of Santa Aha is directed to transmit a certified copy of <br />this Resolution to the Governor of the State of California, to <br />each State Legislator from Orange County and to each member of the <br />State Building Standards Commission. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 2nd day of December, 1963. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br /> <br />
