RESOLUTION 63-147 OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AUTHORIZING AN AMENDMENT TO <br />THE CONTRACT BETWEEN SAID CITY OF SANTA ANA <br />AND THE STATE EMPLOYEES' RETIREMENT SYSTEM <br /> <br /> WHEREAS, the City Council of the City of Santa Aha entered <br />into contract effective July 1, 1947, with the Board of Administration, <br />State Employees' Retirement System% providing for the participation <br />of said City in the State Employees' Retirement System; and <br /> <br /> WHEREAS, a subsequent amendment effective September 1, 1963, <br />made by Ordinance NS-672, adopted July 15, 1963, required an increase <br />of 0.15~ of member payroll in the current service rate of the City <br />because of the inclusion of Section 20804.5, the amendment thus <br />provided a new current service rate of 6.693%; and <br /> <br /> WHEREAS, said contract provides in accordance with <br />Section 20127 of the Retirement Law that contributions of the city <br />are subject to change from time to time as directed by said Board <br />of Administration in order to provide for the funding of the benefits <br />on an actuariatly sound basis; and <br /> <br /> WHEREAS, the Retirement Syste~had instructed the city that <br />effective July 1, 1963, it should discontinue the $5.00 monthly <br />payment by the city for each member covered under the 1959 survivor <br />program, substituting therefor a monthly amount equal to 0.229% of <br />the total salaries paid to all members; and <br /> <br /> WHEREAS, the amendment made by Ordinance NS-672, adopted <br />July 15, 1963, was in error in failing to substitute the new rate of <br />0.22~ in lieu of the $5.00 per member charge; and <br /> <br /> WHEREAS, Section 20461 of the State Employees' Retirement <br />Law provides that an error made in a contract may be corrected through <br />amendments approved by the adoption of suitable resolutions by the <br />contracting parties. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That said City Council of <br />the City of Santa Aha authorize an amendment to said Contract, a <br />copy of said amendment being attached hereto marked "Exhibit A", <br />and by such reference made a part hereof as though herein set out in <br />full; and <br /> <br /> BE IT FURTHER RESOLVED: That the Mayor of said City be, <br />he is hereby authorized, empowered and directed to execute said <br />amendment for and on behalf of said City Council. <br /> <br />and <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 3rd day of September, 1963. <br /> <br />AT~EST: , <br /> <br />CLERK OF THE COUNCIL <br /> <br />STATE OF CALIFORNIA) <br />COUNTY OF ORANGE ) <br />CITY OF SANTA ANA ) <br /> <br />SS <br /> <br /> I, DORIS M.
