RESOLUTION 63-160 AUTHORIZING COND~INATION OF <br />PROPERTY NECESSARY FOR TH~ LOCATION OF <br />NEW TALRERT AVENUE <br /> <br /> WHEREAS, in the southwesterly part of Santa Ana there exists <br />no east and west street south of Warner Avenue which affords <br />uninterrupted traffic flow between Main Street and Harbor Boulevard <br />and the present and prospective demands of traffic in the area will <br />increasingly require such a street. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Aha hereby finds and determines that public <br />interest and necessity require that a new street will be required <br />between Bristol and Greenville Streets and do require that said <br />City have, take and acquire for street purposes fee simple title to <br />that certain land in the County of Orange, State of California, <br />described as: <br /> <br />A strip of land 40 feet in width bounded westerly by the <br />East line of Bristol Street; bounded easterly by the west <br />line of Assessor's Parcel No. 140-182-4; the south line <br />of said 40-foot strip being a straight line which if <br />extended would intersect the center line of Main Street <br />at a point 2126.79 feet north of the intersection of the <br />center lines of Main Street and Sunflower Street, and <br />said south line of said 40-foot strip intersects the <br />center line of Bristol Street at a point 2099.30 feet <br />north of the intersection of the center lines of Bristol <br />Street and Sunflower Street. <br /> <br />BE IT FURTHER RESOLVED: <br /> <br /> 1. That the City Attorney is hereby ordered and directed to <br />bring an action in the name of the City of Santa Aha to condemn <br />said property necessary to be taken and to do all things necessary <br />to prosecute said action to final determination; <br /> <br /> 2. That the public interest, necessity and convenience <br />require and it is hereby ordered that the City take immediate <br />possession and use of the property herein ordered to be acquired <br />upon compliance with the requirements of law applicable thereto as <br />a right of way for public use; <br /> <br /> 3. That said public improvement is planned and locate~ in a <br />manner which will be most compatible with the greatest public good <br />and the least private injury; <br /> <br /> 4. That the City of Santa Ana, a municipal corporation, is <br />authorized and empowered to provide for the opening, establishment, <br />extension, widening, construction and maintenance of public streets <br />and highways for the benefit of the City and the citizens thereof; <br /> <br /> 5. That said action in condemnation shall be taken in <br />accordance with the provisions of the Code of Civil Procedure and the <br />Constitution of the State of California relating to eminent domain. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 16th day of September, 1963. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br /> <br />
