RESOLUTION 63-183 AFFIRMING THE DECISION OF <br />THE PLAATNING COMMISSION TO GRANT A VARIANCE <br />ON VARIANCE APPLICATION NO. 1836 FILED BY <br />THOMAS T. RUSSELL, SUBJECT TO CONDITIONS <br /> <br /> WHEREAS, after public hearing on notice, the Planning <br />Commission granted a variance on Variance Application NO. 1836, <br />filed by THOMAS T. RUSSELL, to permit the construction of a <br />40-unit, 10-building, 2-story apartment complex on A-1 property <br />located at 4120 West Fifth Street, Santa Ana, California, subject <br />to conditions; and <br /> <br /> WHEREAS, Appeal Application No. 103 was duly filed by BARNES <br />F. HUNT appealing the decision of the Planning Commission and <br />requesting a hearing on said variance before the City Council; and <br /> <br /> WHEREAS, after public hearing on notice, the City Council <br />has determined that the decision of the Planning Commission should <br />be affirmed and that said variance should be granted, subject to <br />conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana hereby affirms the decision of the Planning <br />Commission to grant a variance on Variance Application No. 1836, <br />subject to conditions as follows: <br /> <br />That a revised plot plan be submitted to and approved by the <br /> City Planning Department; said plan to incorporate the <br /> following features: <br /> <br />a. Less than 50% land coverage as defined in the R-4 <br /> District; <br /> <br />b. A non-monotonous orientation of buildings and open <br /> space while continuing to maintain: <br /> <br />c. Separation of vehicular and pedestrian traffic as <br /> per plan now under consideration. <br /> <br />e <br /> <br />That all provisions of the R-4 District be complied with, <br /> excepting for two-story construction. Said two-story <br /> construction shall be limited to studio apartments. <br /> <br />That the applicant submit a continuing offer of dedication <br /> across the full width of the property measured from the <br /> south property line to a point 30 feet north. <br /> <br />4. That development be according to a revised plot plan approved <br /> by the Planning Director. <br /> <br />5. That the following conditions are to be complied with prior <br /> to the issuance of a building permit: <br /> <br />That the subdivider's engineer furnish the Department <br />of Public Works a run-off study based on a storm of a <br />ten year frequency. This study to show existing and <br />proposed facilities and method of draining this area and <br />tributary areas without exceeding the capacity of any <br />street, on-site or off-site. <br /> <br />bo <br /> <br />That the subdivider's engineer furnish the Department of <br />Public Works an on-site drainage flow plan showing the <br />direction and flow to adjacent streets when this property <br />is developed. <br /> <br />That the subdivider's engineer furnish the Department of <br />Public Works a final grading plan including existing <br />elevations along the property. <br /> <br /> <br />
