RESOLUTION 63-184 AFFIRMING THE DECISION OF <br />THE PLANNING COMMISSION TO GRANT A VARIANCE <br />ON VARIANCE APPLICATION NO. 1837 FILED BY <br />CECILIA M. BAILIE AND ALBERTA M. BROOKS, <br />SUBJECT TO CONDITIONS <br /> <br /> WHEREAS, after public hearing on notice, the Planning <br />Commission granted a variance on Variance Application No. 1837, <br />filed by CECILIA M. BAILIE and ALBERTA M. BROOKS, to permit the <br />construction of a 56-unit, 14-building, 2-story apartment complex <br />on A-1 property located at 3922 and 3930 West Fifth Street, Santa <br />Ana, California, subject to conditions; and <br /> <br /> WHEREAS, Appeal Application No. 104 was duly filed by JULIE <br />KOMROSKY on behalf of the VUICICH FAMILY appealing the decision of <br />the Planning Commission and requesting a hearing on said variance <br />before the City Council; and <br /> <br /> WHEREAS, after hearing on notice, the City Council has <br />determined that the decision of the Planning Commission should be <br />affirmed and that said variance should be granted, subject to <br />conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana hereby affirms the decision of the Planning <br />Commission to grant a variance on Variance Application No. 1837, <br />subject to conditions as follows: <br /> <br />That a revised plot plan be submitted to and approved by the <br />City Planning Department; said plan to incorporate the following <br />features: <br /> <br />a. A non-monotonous orientation of buildings and open space; <br /> <br />b. Separation of vehicular and pedestrian traffic as per <br /> plan now under consideration; <br /> <br />c. That all units be of one story construction or studio <br /> type apartments. <br /> <br />That all provisions of the R-4 District be complied with, <br />excepting for two story construction. Said two story construc- <br />tion shall be limited to studio apartments. <br /> <br />That the applicant submit a continuing offer of dedication <br />across the full width of the property measured from the south <br />property line to a point 30 feet north. <br /> <br />4. That develolanent be according to a revised plot plan approved <br /> by the Planning Director. <br /> <br />5. The following conditions are to be co~plied with prior to <br /> issuance of a building permit: <br /> <br />That the subdivider's engineer furnish the Department <br />of Public Works a run-off study based on a storm of a <br />ten year frequency. This study to show existing and <br />proposed facilities and method of draining this area <br />and tributary areas without exceeding the capacity of <br />any street, on-site or off-site. <br /> <br />be <br /> <br />That the subdivider's engineer furnish the Department <br />of Public Works an on-site drainage flow plan showing <br />the direction and flow to adjacent streets when this <br />property is developed. <br /> <br /> <br />
